Hello, I have started to fill out form I-129f and for part 3 item number 4.a i answered yes. Cause i know back when i was 16 i got an assault charge and when i was 17 i got a trespassing charge. so over 26 years ago.  But i do not  have specific dates. i know the assault was community service and the trespass was just a fine. So i did a backround check through the state police. and it came back as no record. so should i change my answer to 4.a to "no"  or just put what i know then include a copy of the backround check with my application?

You should be truthful on the application. Lying on an immigration form is disastrous and could prevent you from petitioning your fiancee ever. I had a charge from 30 years prior to my I-129F filing and I disclosed it on the form but did not read the instructions carefully enough and got an RFE for the official court records of the disposition of my case. They will want those with the original filing so go to the court where you had your charged adjudicated and request official (with court seal) copies. If they have no record of the charges then get an official statement (with court seal) that there are no longer records of your charges and send that in instead.

Sorry i am new to all this. Do i go to the county courthouse or should i go to the individual police departments? also i got this will this work?

No. They do not need your background check, it’s of no value as they do their own checks.

I called the county clerk where my conviction took place and they gave me the instructions on how to request the official court record via mail and I had it within a week. Since my RFE said all court and police records, I also contacted the NY State Police for the arrest record and they provided me with an official letter stating that the age of the arrest meant that the record met the requirements for their record purging regulations and had been destroyed. I sent that in with the official court disposition for the RFE also and my case changed from "RFE Response Received" to "Approved" in like 3 days.

Thank you for your response. I am heading into the county court house today to see what they can pull up. Fingers crossed!!

Didn’t realize today is Veterans Day so the court house is closed. So will have to try again tomorrow sadly. Seems when you are making some progress you hit another wall. But got to stay positive. And keep eyes on the end when her and I can finally be together.

I got my Results back today from the clerk of courts. And it listed a charge from 1997 that was purged in 2006 so i included that. on my i-129f   They also included a page saying nothing else was found. But i remember i got a trespass fine back when i was a minor. But even tho they did not list it. I still put it on the form and all details i remember cause i want to be 100% transparent and take zero chances. So nothing comes up in the future.

  Noticed on your time line you just got married last month congrats!!! Also you just applied for the change of status. good luck on your approval.
