Just another hoop you have to jump thru

Some countries want you to take marriage classes before they will let you get married, another hoop to jump thru.

Then you have the Parental Consent form for some countries, Example age 18 to 21 must have written consent from parents/gaurdians. Age 21 to 25 must have Parental Advice.  That is another hoop to jump thru.

Even if that is required (OP could be in their 80's for all we know), that's still a lot less hoops to jump through than a K-1 visa anyway. CrazyCat's comparison info gives the OP good advice so they can make the best decision for their own circumstances.

CR1 visa all the way! Don’t just look at timelines, also look at the drawbacks of the K1 (the adjustment of status process) because that really isn’t a nice start to somebody’s new life in the US.

I don't like the CR1 Visa personally, I always suggest doing  a K1. But that also depends on your country and what kind of hoops you have to jump thru to do a K1 or a CR1 visa.  Having to travel to get married is another barrier I don't want to deal with, and all the hoops you have to jump thru for that in some countries.

I have found the K1 Visa moves much faster than a CR1 visa.  My K1 took like one month to get approved and fiance was with me in USA after 3 months

When did you file the K1? This must have been a while back?

Also, if the OP has no income, then bringing in a fiancée who can't earn an income until AOS is complete, is a stress / pressure I would not voluntarily choose, especially if there was another option.  Love is great, but being broke won't pay the bills.

I did the K-1 and would totally NOT recommend it.

CR-1 is far superior. It is cheaper in the long run, and the foreign spouse is legal permanent resident upon entry and can actually start a life (work, drive, etc) in the US.

If you are already living together, the Utah online marriage would be a very quick and easy way to get married and start the process.

Hi!

We're trying to decide which visa is the best for us: K1 or CR1.

According to my research the K1 process is taking from 6 to 8 months from the initial filing to interview, is that right? While the CR1 takes at least a year (+ we gotta wait until we get married to start the process).

The case would be processed at the Rio de Janeiro Consulate and we both live together in Brazil, does anyone went through the visa process while together in another country? I just know that we need a joint sponsor cause I (the beneficiary) don't earn any income in the US.

Well,

Thank you all in advance!!

I am going the CR1 route, which is now an IR1 because my husband and I have been married more than 2 years now.  It is taking longer than the K1, but it was the best route for us because I am gainfully employed in his country, and it gives him some time to get some family things in order.  If you are doing fine in Brazil, get married soon and file the CR1.  K1 is more expensive, and they can't work right away. My husband already has a job prospect in the States and will probably be able to start shortly after we arrive.

That is no longer a barrier. The Utah online marriage eliminates those hoops.

Not only that, but in OP's case, they already live together.

I think Brazil only allows Emergency DCF, last I checked

As do all countries since the closure of all international USCIS offices several years ago.

OP, another vote for the CR-1, since you're currently together and the Utah online marriage is available.

I did a K-1 in 2018.  Would do CR-1 in your circumstances.
