[LAWYER QUESTION] Now Trump has won a second term...

Hey y'all,

 

I prefaced this with 'Lawyer Question' but anyone who can provide fact-based insight would be appreciated: Now Trump has won a second term, in theory, where would a legal immigrant stand if the new administration attempted to deport them without due cause? (i.e. I haven't violated any of the terms that would usually result in deportation). 

 

Reason I ask: I'm a gay, legally married, white male, 30 something who has been here legally for nearly eight months now, and I'm concerned that the change in administration (and their attacks on LGBTQIA+ rights) will result in my getting deported without due cause (other than "being gay"). For additional context: we are currently waiting for my green card interview to come through.

 

Any insights would be appreciated, but also, do please keep it civil. Thank you.

I think you are unlikely to have any issues. They are not going to be able to deport people just because they are gay. I doubt any court would even agree to that no matter how conservative. 
 

The people that have the most to worry about would be DACA, undocumented people, or immigrants that have committed a crime.

Because of the policies put forward by the incoming President and because I am a, albeit legally married and legal immigrant, homosexual.

Yeah. The lawyer I spoke to (through this site, actually) said as much, too. So... that's good to know but it's still pretty damn scary.

Yeah. The lawyer I spoke to (through this site, actually) said as much, too. So... that's good to know but it's still pretty damn scary.

I’m also gay, so I can understand the worry. I think things will be okay, I doubt there will be much movement against lgb rights. Transgendered individuals might face more issues though.

Gay marriage is protected under the Supreme Court decision "Obergefell v. Hodges" which ruled that the right to marry applies to same-sex couples, guaranteeing them the fundamental right to marriage under the Fourteenth Amendment of the Constitution.

Yeah. For now, at least. But if they can overturn Roe vs Wade, what's to stop them targeting that, too?

Nothing but a president does not try to overturn laws like that. Groups do that. and it takes years

My husband just arrived here about one year ago and has his 10 year VISA and honestly we are not worried about any of that.....I honestly believe that they have many other battles to fight in the undocumented immigrant front to worry about anyone who entered the US legally and also has status.

He doesn't have policies, a plan...just a concept of a plan about someshit,basically- he says he wants to "do" a lot....but,he can't just do about anything without congress etc.....
