August K3 Filers...

While there are no specific instructions that mandate sending the petitions together, it has been suggested to several VJ members by USCIS. In my case, I was advised by a USCIS officer to submit both the I-130 and the I-129F together. I was told that this would help avoid any confusion with sending the I-130 before the fee change and the I-129F later. Also, she stated that NOA1s were taking forever and that this would save me at least a month or two.

Please keep in mind that this advice was given before the fee change. I would highly recommend calling USCIS and asking to speak to an officer. You will have to deal with a phone rep first, but they should transfer you to an officer if they can't satisfactorily address your concerns.

Hi Guys,

We filed our I-130 and I-129 separately last July (I know, this is for August - see our signature below ). However, I noticed that there has not been much difference between the wait time for a K-3 or IR-1/CR-1 visa lately (see my timeline). Some will still opt for K-3, others the IR-1/CR-1 route - this will depend on your priorities and choices. We are still going for the K-3 but there's still this chance that both your I-129F and I-130 can get approved at the same time or the I-130 to follow a couple of weeks later. If this happens, you can opt to do the I-130 interview instead of the I-129F and enter U.S. with a IR-1/CR-1 visa (am i correct? ).

I filed my I-130 seperatly right before the fee change. I was unaware that I could send both together as well, but hopefully everything will work out. I'm trying to be patient. Only thing is, it's been three weeks now and the money order I sent still hasn't been cashed. I know there was probably many submissions before the fee change and hopefully USCIS is just busy. But if we're going to start an august filers thread sign me up

I talked to the Texas Service Center today and asked them about filing the I130 in Mesquite on Aug 7. They said it was fine, and to send the I129F to Vermont after getting the NA01...BUT...they said that since they had a flood of applications at the end of July from people trying to beat the rate increase so they are backlogged...and it is taking up to 90 days to send the NA01 for people who files in late July/Early August. Bummer. I was wondering why my check isn't cashed yet. Grrrr.

we just filed our I-130 last aug 20 and we didnt know that if u gonna do K3, u should file it both coz we only know that we have to wait for the receipt of I-130 before u could file the I-129.

hope everything will b okay if there's a new filing system... its so confusing!

Obviously, we all decided to file at the most confusing time. I wish I would have done a couple things differently but what can you do. Again, I'm just trying to patient. Hopefully I'll get to see my husband again in just over a month so maybe that will ease my impatience (or just make it worse! lol) I saw somewhere on here some people who had sent packages in in the last week of July and they were just starting to get their checks etc cashed in the last couple of days so hopefully that means we will see some action in the next week or so. Good luck to everyone! Keep me updated on your progress.

i filed for my wife on Monday 8/20/2007 using an I130 receipt that was filed on July19th. I didn't pay the fees as per the new instructions. I will post my receipt notice once i get it.

if anyone received their receipt notice wihtout paying fees for August please post your experiences,

Filed the i130 in July and seperatly filed the k3 to the same location CSC August but also included a check just to be sure, well see if they return my check. Its been over 10 days and no NOA yet.
