DCF Japan - Resubmission

I was denied in September for DCF and unfortunately had to decline an amazing job offer in the USA

 

Today I got a call from HR and was able to secure another opportunity and accepted with a flexible start date of end of December or January. 
 

I have my previous I-130 form completed and other documentation but I worry that if I apply again since it was only 2 months ago they will decline. Apparently the previous DCF was denied because the evidence I provided was insufficient and that was a job offer.
 

To make sure I do provide as much info do you have any recommendations such as what I should be included in a cover letter or anything else I should do to help my request? Is 2 months too early to try again? Will the consular office ban me because they see me asking again?

It is 100% at the discretion of the consulate.  You can ask them.  However, your start date is pretty soon.  I'm not sure you can make it.  Good luck.

DCF is a lot faster, but 1.5 months would be hyper speed!

 

There's a thread just down the page for somebody else that's gone the DCF via Tokyo route, looks like 4 months from application to interview.

I would only have to be there for the initial application with the consulate office right?

 

im hoping if at least I make it to the filing and my wife is in progress spending I hope max 2-3 months away rather than a year period is better 😕 and see if she can visit me while in the process

As I noted in your previous thread, the only ones I personally know that were accepted for DCF due to job relocation were already employees in the Japanese branches of their respective companies and had orders / expiring expat agreements requiring return to the US, not brand-new job offers.

 

Times change though and they may have different criteria these days depending on workload and newer guidance, so don't let that discourage you. I'd suggest having a plan B though in case DCF doesn't work out, such as you going ahead first without the wife. Good luck!

Not sure how I will... I wonder if it'll be brought up and if it does then I can just say that I declined my last opportunity due to the circumstances and continued to apply 

 

I am hoping this doesn't look bad in their eyes as me simply trying to do DCF.

For most people, some period of separation is an inevitable part of the immigration process.

My wife and I just finished the DCF process in Tokyo. It would have taken about 3 months, but we had to delay the final interview for about one month since my wife needed to travel outside of Japan and we didn't want her to have her interview until she had returned from that trip.

As for the cover letter, I made sure to describe my wife and I's relationship, the nature of the job offer I had received, and the importance of the job for the success of my career and my professional relationships, and how long term separation from my wife would negatively impact our lives.
