Timeline

I recently just withdraw my K1 visa with my fiance due to me not being able to finish my school on time in my country to marry her within the period but we did not break up. She’s upset and she say she does not want to wait another 2 years. What should I do after I finish my school? Is there any ways I can marry her less than 2 years ? Because I know after 2 years we need to file and then we need to wait another year

 

lets say I cancel today, and I finish my school by october 2025 is it possible to file earlier ? But with the same person which is my fiance?

You can marry now  and then file for a spouse visa     It won’t be any quicker but it’s a much better path to permanent residency

What do you mean? I’m in Singapore and I’m studying still, but shes an american she applied the K1 visa but I’m just here posting on this thread for us for any advise. Like what do you mean marry? Just fly over to marry when I’m done?

You can meet and marry now and apply for the spouse  visa. The time for the spouse visa to be processed will be 18 months or so and you then have 5 months or so to enter the US on that visa. That fits with the time you still have to stay in Singapore to finish your studies.  You become a resident the minute you enter the US .. And do not have to go through any other processes before you are able to work   That’s how it’s a better way .. if you enter on a fiancé visa you must then marry, apply for adjustment of status and a work permit .. both hefty fees.. And wait months at least for the work permit and over 12 months for your lpr status.

Or her fly to you, marry and file the I 130

 

that way you should be able to move say in the summer of 2026 and enter as a Lpr

That is immigration fraud

Then either you travel to the US to marry and return home or meet in a 3rd country where you can marry, or do Utah virtual marriage and meet in person after that , then file the I 130

It’s fraud to travel on a B visa or the VWP to marry and adjust status.   That’s exactly why you need the CORRECT visa to do that - a K-1.

 

Why would there even be the need for K-1s if it was perfectly fine to just fly over, get married and stay?

So which is it? Did you already withdraw your application? Or are you considering withdrawing? If you have not withdrawn yet, don't. There are ways to lengthen the process so you may be able to delay things until you are ready to move.

 

You seem highly confused about the different processes. You and your partner should BOTH be doing a lot of research to better understand what works best for you.

@vivian57 Have you canceled the I-129 already? If not, when did your fiance file? If you haven't withdrawn the application yet, don't. You can lengthen the time to be perfect with your school completion. It would be in your best interest to lengthen the application time within each of the steps over canceling and reapplying. The cost alone should encourage you to not cancel. The fees are not refunded and would have to be repaid.

 

I also must echo what Marieke H said above. You both should know how this process works by researching on the USCIS website and read through everything. Also research how long it actually takes from start to finish without lengthening the time. The timelines for others currently is a year from submitting the first application to their fiance coming to the US to finally be married.

 

Side note: I don't blame your fiance for being a bit upset. Waiting to start your life isn't comfortable or desirable for most folks. We don't know how much time we are given to live and so much can change month to month, let alone year to year. I wish you the best outcome for your and your partner 💜
