Crossing US/CAN border with USC husband, while having B1/B2 visa - potential issues?

Hi all,

 

I recently got married, and my wife has been living in Canada, in a border city. She needs a B2 visa to enter the US, since she is a citizen of a country that requires a B1/B2 to enter the US. She recently got this visa, so I'm somewhat paranoid at the moment, and don't really want to do anything to get it revoked.

 

I am a US citizen, recently naturalized this year. I plan on moving in with my wife soon, but not yet (just personal and financial reasons). I have been frequently visiting her, 2-3 days per week mostly on weekends. I am also a citizen of Canada.

Applying for CR-1 is in the plans, but I have not yet done so.

 

I would like to cross with her into the US from time to time to visit. She doesn't have a car or a license yet, so I would be driving her back and forth, which isn't an issue for me. What are the chances of running into issues with CBP with this plan?

 

As for me, I have been honest with CBP/CBSA so far. I always tell them that I was in Canada visiting my wife; No, I have not applied for benefits; She lives there and works there. So far this hasn't caused me any issues.

 

Any insight will be appreciated!

She has a B2 visa, so she can enter the US for short visits, subject to CBP approval of course.  If she is completely honest about the purpose of her visit, she should be fine, if the visits are not too long and not too frequent.  She should carry evidence of her strong ties to Canada--job, property owned, etc. with her if they ask any questions about that.  She may have to convince the officer that she will leave the US before the authorized stay expires.

Hopefully you realize that she cannot enter on a B-2 with the intention of adjusting status.  You need to petition her properly for a CR-1 visa.  

 

Depending on the length and frequency of her visits, she could encounter issues with CBP.  There are many threads about this on VJ.  Also worth noting that she is not permitted to work remotely while visiting on a B-2.

Yep, fully aware. Just preparing all the documents to submit the I-130. Her job requires her to be in person and remote work isn't possible, so that shouldn't be an issue. I'm guessing it'll be less sketchy once I move in with her in Canada and I submit the I-130.

You will also need to read up on domicile requirements for Montreal - they tend to be quite strict.
