  • Jake77 changed the title to N400 - Never Married (Do I need a proof of this?)

Complete question:

"Have you EVER not filed a Federal, State, or local tax return since you became a Lawful Permanent Resident?"

Context:

- Never worked after becoming an LPR.

- Still no work as of now.

- Received no doc. regarding taxes (Except the W8-BEN from a Bank.)

...

Should I answer No?

And if I answer no, do I need to provide any explanation / proof?

Your answer is "No" if you were never required to file taxes.  Answer "yes" only if you were required to file, but didn't do so.

This is a question they could have worded better.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Never done taxes in my life so I need to confirm this.

I received a W8-BEN from Bank of America to fill out and never sent it back. (Changing to another bank soon is my reason.)

My answer should remain "No" because W8 is not the same as Tax Return, is it?

No, W-8 is nothing like a 1040.

The final parts of the N-400 (Part. 16 to 18) are suppose to be completed at the interview.

Basically, these parts are asking for my:
- Printed name.
- Signature.

(It also has fields to be signed by the Interviewer.)

But there's a note that reads: DO NOT COMPLETE PART 16 - 18.

Under normal circumstances, that makes sense.

But because my interview will done ONLINE and in Boot Camp do I put in my name NOW and signature in case they mail this to the US Immigration Services?

Because if they do mail it, I won't be able to personally write my name and signature.

Part 8. Information About Your Employment and Schools You Attended.

"... Begin by providing information about your most recent or current employment, studies, or UNEMPLOYMENT ..."

Do I list my home address in the Philippines and America because I was unemployed  and still am unemployed here in the US?

No employment and no income are two different things. Did you have taxable income that you did file taxes for?

It's possible to have taxable income without employment.

Example: you have a property you rent out in Philippines. Or you have $1000000 in stocks that pay you dividends. Or you inherited $100000 from uncle who passed away.

Literally 0 property / stocks. No investment in anything. Was living with my relative when I was in the PH.

I had no job.

I had no income.

I have never been sent any document from the IRS either.

I arrived here 7 months ago in February.

If you only arrived in February then are you sure you meet the requirements for naturalization?

The Marines have this thing where you can be interviewed by the USCIS while in Boot Camp. It's a recent thing that started this April.

We are instructed to bring N-400, N-426 and other things with us when we arrive at training.

We are exempted from thr longer period of waiting before naturalization.

Ah, if you’re military that makes sense now. So no tax return has ever been due anyway then - you arrived part way through the 2024 tax year and the return for that won’t be due until next spring.
