Hello friends. I have a friend who has a relative that came on a tourist visa and had her baby here in which he became citizen afterwards. Can that child return at the age of 6. When his mom comes back on a tourist visa and attend an elementary school? your help is always truly appreciated.

I'm assuming your saying the child is a US citizen by birth.

Why does mom need to go to elementary school? I think what you mean is... Can mother stay in the US on tourist visa while a 6 year old child goes to school?

 

The answer is no.

If the real question is whether the mother can remain in the US, the answer is no.  US citizens can return and attend school at any time. However, the return of the child, as a citizen, gives NO rights for the parent to stay beyond the time given by CBP for the visit.  At age 21, the child can petition the mother.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
