Good afternoon. We filed for the K1 back in early March 2024.   We got an approval late May. We got a letter stating our petition has been sent to Department Of state.  We didn't hear anything or get any letter email or mail.  We inquired in July from DOS and was told that our petition was sent to the embassy or Consulate in July. Still no letter mail or email. We are just patiently waiting for the next steps. Fast forward to a few days ago, I received a letter from the embassy in Frankfurt saying our petition had expired.  The embassy we picked to be interviewed at is in Nigeria. I'm just confused as to why Frankfurt would have our petition. There was no communication to let us know anything. The last letter was from USCIS. We wouldn't have know our case was sent to DOS if we didn't inquire.  I just don't know what to do or who to contact. I have emailed Frankfurt and haven't received a reply yet.  Any help or directions would be greatly appreciated

Did your fiancé live in Germany when you sent the petition? NVC automatically sends the petition to the country where beneficiary states they currently live in. They do not look at the field where you put the consulate you want to interview at. This has been known for many years now if you search the forum. 
 

If she didn’t live in Germany, then this was an error on NVC’s part but that’s more rare than the scenario above.

 

It is on the petitioner and the applicant to reach out to NVC after 3-4 weeks of USCIS approval so find out the case number to track the progress. This is also written in the guides and next steps here.

 

Now that the petition already left NVC and is now in Frankfurt, you need to contact the consulate in Lagos and ask them to request the file from Germany. Note that this will take several months to resolve, my guess would be a three month delay.

Thank you for responding. He has never lived in Germany or been there. He currently lives in Cyprus. We know there's a mistake or miscommunication somewhere, we just don't know where. I reached out to DOS and they said they can't do anything that we need to reach out to embassy. I did send Frankfurt embassy an email.  I hope they respond soon. We thought about reaching out to the embassy in Nigeria.  I will do that and hope for the best.

Your U.S. Congressman's office might be of help.  Call and ask for the "immigration liaison."  There will be a form to fill out in order for the office to contact others on your behalf.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As the person above said, it goes automatically to the embassy for whatever country the beneficiary lives in.

since your fiance lives in cyprus, the embassy in cyprus no longer processes immigrant visas. There are several embassies that have consolidated their immigrant visa processes to Frankfurt. Including fiance visas
