Hi All..

Just posted this on the AOS forum but wanted feedback here as well...as you can see from our timeline we are about to have our medical exam for the K3 and have already been given an interview date. We've also paid the IV bill and sent in the DS-230 for the CR-1. I've been now told on another forum that we won't be able to Adjust Status in the States--we will HAVE to do the consular route in Germany for the CR-1.

I-130/CR-1

10/7-12/29/05: NOA 1+2

8/10/06: case received in Frankfurt--get letter asking for more info

think we'll adjust in the states...

K3

2/7/06: NOA 2

4/24/06: Interview in Copenhagen

5/17/06: Sent additional info. requested

8/9/06: e-mail from embassy that they are ready to issue visa

8/23/06: visa in hand

You can adjust status in US, by filing for AOS (usually after you get your I-130 approved) as long as you tell the NVC upon your I-130 approval that you want to adjust status in US and tell them not to send your I-130 file to the embassy. I saw in your other thread that you already paid the IV bill to NVC. That means you already "chose" that you want to go through IR-1 route and not do AOS in US.

Does paying the IV Fee bill close the door on adjusting status?

TIMELINE (Married 9 yrs)

Aug 18, 2005 - Mailed I-130 (wife & kids') to VSC

Aug 29, 2005 - NOA-1 for I-130's received

Sep 13, 2005 - I-130's approved, petition forwarded to NVC

Oct 10, 2005 - I-864 Bill received by agent

Oct 12, 2005 - Paid I-864 Bill by Postal Money Order-$70 for whole family

Dec 17, 2005- checklist for I-864 received, reply sent back & entered into system on Dec 22.

Oct 20, 2005 - Alien spouse received DS-3032 (Choice of Agent) documents

Oct 24,2005 - DS-3032 sent to NVC (fr Phils)

Nov 17, 2005 - IV Fee Bill paid by Money Order & sent

Jan 3, 2006 - Mailed DS-230 to NVC

Jan 4, 2006 - DS-230 entered into system

Jan 12, 2006 - CASE COMPLETED, and still waiting!!!

Aug 3, 2006- schedule of interview at US Embassy-Manila. Won't be showing up.

K3/K4

Aug 30, 2005 - Mailed I-129F to Chicago(wife's)

Sep 10, 2005 - NOA-1 for I-129F

Oct 19, 2005 - I-129F Approved (email notice), received mail Oct. 28

Nov 2, 2005- Received K3 approval notice

Mar 24, 2006 - K3 interview

Apr 4, 2006 - Visas in hand

May 8, 2006 - arrived in America

AOS

August 2006 - mailed I-485 forms

September 2006 - Biometrics done

December 2006 - Interview; Green Card received by mail a week later

2007: Applied for kids' certificate of citizenship, got the certificates in June & passports in August 2007

Hmmmmmmm all i can tell you is my story (ENGLAND), I came here on a K3, but followed the NVC processing of my CR1, it was always my intention to go for the CR1 as its the better visa, a few conversations i had with NVC AND London Embassy i was asked a few times if i wanted the processed petition sent back to the US for interview here, I said NO as it takes too long!!

you are practicaly done at NVC, I honestly think you should stay with the CR1/IR1 as it has FULL benefits e.g no applying for EAD .... :yes: ...see if you can find out how long you will likely have to wait for an interview in Germany!!

I say this as who knows how long you will have to wait if you chose to AOS with already processed papers at NVC!!

OR maybe come like i did on K3 & return for your CR1/IR1 interview.............your so close to the visa we are all here for!!! having the interview at the Embassy/Consulate means when you enter the US this will trigger your greencard in the mail (so to speak)!!

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

Agreed.. if they do this, they can save on the medical and trip to Denmark (saw that she was concerned about this in other posts).

Why don't you wait for the IR1-interview instead of going to the K3-interview? It shouldn't take much longer since your NVC-application seems almost done. There's also a chance that you can ask the consulate for an IR-1 interview instead of the K3 if your file has already arrived at the embassy. The advantage would be that your husband would be able to work immediately and get a green card without AOS. It's also cheaper by a few dollars...

Not quite sure how that would work in your case since you seem to be doing things at 2 consulates... But wait times for Germany are relatively short; I got an interview 3 weeks after my case was received by Frankfurt, and normal wait time is 4-6 weeks.

Just looked at your timeline and wanted to add (since there seems to be a problem with your affidavit of support): Germany only needs most recent tax year (at least that's what they told me when I went there last week).

The main reason we're going K3 is time: I need to be back in the States this summer and I want my husband to come with me. The wait times for all non-Middle Eastern nationals may be relatively short but I'm almost sure we're going to be put on some kind of AP and/or the security checks will drag on because my husband is Iranian. We already have an interview date April 24; I don't want to chance having to wait another 8-9 months for the CR-1 to finish.
