[I-130/F31] NVC partially accepted some of my documents but Removed my Child from the applicants list after submission of iv fee and full documents.

Our case was filed in 2006 (when my child was 5-6 years old) by my U.S. citizen mother, but she passed away in 2009 (NVC wasn’t informed). The case was approved in 2019 when my child was 19. Does the Child Status Protection Act (CSPA) apply? After my mother’s death, my brother, a U.S. citizen, became the substitute sponsor. NVC returned the case to the USCIS in 2019 and it stayed with the USCIS for a long time before finally being approved and sent back to the NVC in 2024. We paid all the fees and submitted the documents, but the NVC removed my son from the case. He is now 23-24 years old. What are the next steps, and how should we proceed?

@appleblossom We got the Welcome Letter (attached further below) from NVC in 2019 is what I mean. However, see this letter from NVC I got in March 2006, I'm not sure what it exactly is. Please help.

Unfortunately that doesn't. You need to know the exact date the I-130 was approved, as the time was pending for can be taken off your child's age for CPSA calculations. For example (as a very basic example), if it took 2 years to be approved, then your child would actually be eligible to get a visa up to the age of 23, as you'd add that 2 years on to their real age.

OK, so March 2006, only 3 months for processing - which means your son has aged out it appears. 

 

I thought that humanitarian reinstatement was only possible if you are in the US, but presumably that's what the revocation/reinstatement was about.

@appleblossom Oh that's a shame, is there no relief given due to the extra time it took for processing the reinstatement? What should my realistic next steps be? I'd prefer to bring my son with me if possible. He was 19 when we received the welcome letter and were told to pay the fees. Should I consider an attorney?

An attorney cannot do anything here.   Numerically limited visa numbers are what they are.

 

Consider yourselves lucky that it was reinstated at all- not everyone gets to have that.
