Administrative Processing of the CR-1 Spouse Visa over the 16 months

I am a Pakistani doing an industrial PhD in the Netherlands. Whereas, my wife is a US citizen. We submitted our application for a CR-1 spouse visa in February 2022. It took one year for our I-130 to get approved and get an interview. My interview took place in July 2023 at the Amsterdam Embassy. After the interview, they asked for my CV along with information regarding my publications. It's been more than one year since my application was in administrative processing. We tried to reach the embassy through Senator and email, but the response is always the same: it is under administrative processing and you have to wait.
 

At this time, it's becoming difficult for me and my wife to plan ahead. Some of the lawyers suggested going for the Mandamus Lawsuit, but is it feasible at this stage, taking into account that it is expensive?

Since Administrative Processing cannot be expedited, a WOM or continuing to wait are your only real choices. It is feasible.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unfortunately, VERY long administrative processing is expected for Pakistanis especially Pakistani men. It takes very long for embassies to background check and validate documents related to folks from Pakistan. USEM doesn't even accept police certificates from Pakistan because those certificates can't be trusted.

The whole idea with WoM is that it never reaches the judge and gets decided before that.

What options and recommendation everyone can give? I am open for it. Considering that I am from Pakistan, got a PhD in data and semiconductor domain and a Muslim. 😅

I applaud your sense of humor considering how onerous the immigration process can be.😅. There have been many cases same/similar to yours from people from Pakistan on VJ. Let me see if I can dig up any of those threads to see if anything may be useful for you. Personally, I'll say you got to wait it out but there might be some better recommendations out there. On the plus side, I think many countries will be glad to welcome people like you with such qualifications including the US so don't see it as a negative.

Thank you for comment @nastra30.  Need suggestions, do you think that it is the best time to file for mandamus lawsuit or should I wait 6 months more?
