Hi VisaJourney!

 

My wife and I are seeking clarification on the police certificate requirements for our upcoming steps in the IR-1 visa process. The criteria as it's laid out seems to state that she needs to submit a police certificate for "any previous country or countries of residence if residing there for more than 12 months".

 

Around 10 years ago, she spent less than 12 months in Japan at a study abroad program. And then around 6 years ago she spent less than 12 months in Japan again at another study abroad program. Cumulatively, these periods well exceed 12 months but individually neither do.


With how USCIS has worded the requirement, it's unclear to me whether she is required to submit a police certificate for this. Do any of the knowledgeable people here have experience with a situation like this and can provide guidance or clarification?

My literal interpretation is that it is not needed, but if available, I would get it anyway.
