221g in the interview and no answer about approval or refusal visa

Timeline

I don't understand what happened in my IR1 visa interview. I recently had my interview at the consulate in Rio de Janeiro and the consul was supposed to ask me for a 601 waiver, but in my interview, besides not even saying the waiver, he didn't tell me if the visa was approved or denied, he just gave me a sheet of 221g asking for a document. I took this document to CASV, the visa application service center, and there the lady said that my passport would arrive at home with my visa approved? What do you mean? Is this a miracle? But when I get to the visa tracking, it shows as refused? What's going on? And when will I get my passport back? Can they still deny it or ask for a waiver? I'm confused and distressed...

Lawyer told I needed cause I was overstayed before married, since this was during pandemic, cause work and cause I left the country while my aos is pending.

What is matter now??? 😒 the consul already know about that… I am asking about the interview… why they ask me a 221g and the girl on casv told me I was being approved? 😡😭😭😭 I was since may 2020 until January 2022 when I married . April 2002 i started my aos process

My other question is relevant.  What color was the 221g.  The different colors are meaningful as to how the interview went.  I don't know CASV.  Also, if the stay was less than 180 days, no bar is in place, if over 180 days to 365 days, a 3 yr bar, and over 365 days a 10 yr. bar.  You asked why the CO did not mention a waiver, if the overstay was less than 180 days, no waiver is needed, and if between 180 and 365 days, I suspect you have already been outside the US for more than 3 yrs, so a waiver would only be needed if over 365 day.

You don't understand???? My exemption was during the pandemic, one year and eleven months! I know the waiver and bar rule but the CONSUL DID NOT ASK ME FOR A WAIVER, He just gave me a white sheet asking for another document that has nothing to do with bar! CASV is the place where we go to get the forms and have our fingers printed and there the girl told me that my visa was approved and that I would receive the passport at my house!

If you responded to the 221g appropriately, all you can do is wait and monitor the CEAC website.  If the consulate needs more, they will ask for it.

Refused, does not mean Denied/Rejected.  Refused only means that the consulate needs more time.  They used to use the generic Administrative Processing all the time, but now they are saying Refused when a decision cannot be made at this time hence the 221g, and in this case a white one means they are still looking at your case.  Since they kept your passport, that is positive, so just keep monitoring the CEAC website.
