Needing Advice about Petitioning a Foreign Spouse after past K1 Visa Marriage was Annulled due to Fraud

I love the way people cant help but give unsolicited advice.  Feel better?  You have no idea how I "scrutinized" this fraud relationship.  But you make a judgement about who I am, because *I* was scammed.  You do realize that good, intelligent, well meaning people get scammed right?  You do realize that intelligent people can be tricked by manipulative scammers, right?  Now I am sure that has NEVER happened to you, but for the rest of us, it's possible.

 

Now if anyone else cares to address the actual question I asked, please feel free to chime in.

No  one will ever know, perhaps she was ignorant, perhaps she does not care? I know people who are here without documentation, they just live their lives.

Well to be honest...I'm not sure she thought much past the "I want to be in the USA" part.  She certainly *seemed* to want the relationship, and she said all the right things, and seemed to want the same things I wanted.  In the end you're right, I probably will never know, and at this point I couldn't care less.  She's the past, I'm looking forward to the future.

You can learn something of value from everyone engaging. ..including poster that irked you. 


For an immigration context, in some high fraud countries consulates actually do consider a USC petitioner’s vulnerability to online scam romances…without the USC fitting such criteria as being disabled or impaired. ..and you end up in the black hole of administrative delays and the elusive not enough bonafides .
 

Yes, you got scammed and Dang ! you were super lucky she didn’t play the deception game longer . …and as you said, people can seem genuine, say all the right things …long distance has it’s own challenges.

You dodged a bullet in that she didn't understand or stick around for Adjustment.

If your new relationship progresses, make sure that she knows all about the scam situation.

The Bogota consulate might ask her for details about it, at the eventual visa interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Also, the scammer may realize she will not be able to adjust and will try to come back in hopes of claiming Wawa. Be vigilant about any attempt to reconcile. 

You did good with the annulment. Very smart on your part. This is the best revenge, ensuring it will be difficult for her to adjust status another way. 

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

Everyone who has lived for a while I would think has been scammed one way or another, we live, we learn and I agree what happened happened and there is no ability to go back and change it.

 

I have seen much much worse, maybe not a lot of help, it could have been really bad.

 

Anyway her Immigration situation is hers, and Annulment is not a total barrier for Immigration purposes but if she was thinking of VAWA then you will never know and with an Annulment well that is going to be a BIG ask.

 

Despite coming on a K1 like most people I would suggest Marriage and CR1, one of my live and learn moments. I assume she does not have a US Visitor Visa and would find it hard to get one.

Yes she already knows about the situation.  It's not something I would bring up on a first date, but it's definitely a future partner should know, and she does.

Well I can assure you, knowing now what I do about how some women use VAWA as a way to manipulate the system, I would never allow her on my property, much less be ALONE with her!

I have been told that there are closed Facebook groups that specialize in sharing VAWA info, but she has made this very difficult for her.

I agree wholeheartedly with this. I would be so my own sue diligence before I petitioned for another foreign spouse. You are brave because after that experience, I would not have done that again and if so, not a high fraud country. Focus less on the immigration piece and more on the legitimacy of the relationship so that when you do file, you are confident that you can withstand and additional scrutiny.

Not sure why you feel so attacked here. The 'feel better' comment was a little uncalled for. If you post a story like that on a forum you can expect people to warn you now that you are in another relationship with a foreigner from a high fraud country. Maybe I am weird but you and your new girlfriend have only been in a relationship online and only for a few months. To me that would not be enough to risk getting myself into a similar situation. Hence why I said I would make sure to spend time in this relationship before committing to anything. But if you think it's valid to yell at me for that, please be my guest.
