How can I prove I make enough income? Do all 3 years count?

I am trying to sponsor my spouse, and I consistently make enough income. I’m self employed.

 

My 2023 and 2022 returns show I made over $34,000.

 

My 2021 however is a mess. I had an issue with my accountant and that return is being amended at the moment. It is way below the requirement. This is due to a previous accountant completely forgetting to add a 1099. After it’s amended, it should be well over but there won’t be anything official in my transcripts for 8-20 weeks.

 

I had been advised more than once that they mostly only consider the most recent year. Is this true?

 

I’m using a service (Simplecitizen) and they won’t let me proceed with the application when I apply what it says my 2021 income was. It doesn’t give me an option to leave out 2021.

 

Is this something I could explain to USCIS, or if I decide to DIY, could I just include a letter from my accountant with my tax documents for that year (my 1099, bank statements, etc)? Or can I leave 2021 out all together?

 

I have no option for a joint sponsor as I make a lot more than my family and have no close friends.

Looks like the service you're using is trying to push applicants to go the safest route to avoid delays and RFEs.

 

Waiting for transcript being available or until you filed 2024 taxes is one option.

 

Another option is to invest your own time in the process and not pay the middleman for no reason and file without 2021 tax return. By the time you get RFE you'll have 2021 and maybe 2024 tax returns available.

 

I'd personally go for second option. There's nobody in this world who needs this case approved more than you. No notario / service is going to care as much about it as you. They make silly mistakes with scary consequences all the time, because they spend the minimal time on it.

Our biggest concern is my husband is getting so depressed for being unable to work. Will the RFE affect him getting a work permit?

So we can get your question into the best forum, can you please confirm what process you are going through ! .. Your question about RFE delaying the work permit seems to indicate v that he is here in the US and he is applying for Adjustment of Status   Is that correct? If it is, what visa did he use to enter the US? K1 fiancé ? Student? Visitor ?

he entered as a visitor on a B2 visa and he’s applying for his adjustment of status.

Please read the I-864 instructions. You are only required to include your most recent tax transcript. You will report the income for the other two years, and you may include those transcripts if you think they will help, but they are not required.
