F2B or marriage, Im torn between a visa or a 7 year relationship.

Long story short, I have a gf for 7years, and i am also the proud beneficary of a 8-year-wait-no-end-in-sight-F2B-visa, it's getting to the point where i have to pick one. And im so torn apart.

On one hand, I love my girl very much and she's probably the love of my life, but aside from the petition we have other problems, and sadly dragging this out for this long may have done unrepairable damage.

On the other hand, I like the US very much, like a lot of F2B kids, my family already lives there, and I lived there for my childhood, everytime i visit my family im always so happy and wants to live there with them so badly.

Im considering EB visas but judging by how things are rn they also seem like a very long wait, I dont have anyplans to go to school since Im kinda done with being a student. So yeah hell of a pickle

I kinda know this is more about life advice rather than immigration law, I just don't really have a lot of people that can chip in and give advice.

It all really depends on your priorities.  If this person is the one, foster that relationship, and I realize that an LDR is difficult particularly with the specter of navigating immigration concerns, it can be very rewarding in the end.  I am not suggesting you take one path or the other as I certainly do not know the whole story from a few sentences on a VJ post, you need to look at your specifics and decide the path yourself.

EB2 NOW is very popular and much quicker than F2b

Not sure why you think EB visas take as long? I got mine (EB1) in 5 months last year, far quicker than any other route to a green card. If you’re eligible then that’s a great option, but you’ve not specified which EB route you’d be eligible for?

Also, if you’ve been waiting for 7 years then another option would be for your petitioner to apply for citizenship? It would take even longer but at least then you could marry whilst waiting and take your new wife with you!

thank you for the advice! Im not really sure if im eligible for a EB1 since Ive read the critirea and barely fit 1-2, i assume youd have to have a phd or be very excellent in your field.

I don’t have a PhD. But you would need more than ‘barely’ fitting 2 criteria. Our lawyers said 5 - the requirement is 3, but if USCIS disagree with one or two it’s better to have back ups. 
 

When can your petitioner apply for citizenship? That may be your best option to keep the girl and move together.

I see, Im consulting a lawyer right now and seeing if the EB2 or EB3 could work, the petitioner is my parent and they dont have plans to naturalize, thank you for your input!

With an EB it is the Employers lawyer you need to contact.

Could your parent not naturalise for your sake? 

 

EB2 or 3 is going to be another 5+ years, probably longer unless you find a sponsoring employer/job offer straight away. You say above you’re 8 years in to your F2B wait? So presumably have done the NVC side of things and it’s not too long until you’ll be eligible for a visa? So that may end up being a lot quicker, and a similar wait for your gf if you marry once you have a GC.

They could but naturalizing would make my case even slower, plus i dont want to burden them more, if the EB works i can keep the girl and move on with life, i see EB 2 PD is 4years from being current.

I'm 2 years into the F2B wait, havent even got approved yet, i suppose a 5 year wait is minimum for me.

Oh, I see, I thought you were 8 years in. Yes, at the very least, probably longer I'd guess.

 

Them naturalising may make it slower, but you could marry, which is the big advantage in your situation.
