I-130 + I-864 (Affidavit of Support) for mom

Hi everyone,

I would appreciate your advice.

 

I am the US citizen filing I-130 for my mom who is currently in the US. My dad is also in the US  but I am not filing for him right now.

I have a question about the I-864 form (Affidavit of support), part 5 “sponsor’s household size”.

 

Here is the situation:

Me (U.S. citizen) – the petitioner

My spouse - joint tax filer

 

My mother I-130 beneficiary

My father  - not being sponsored at this time

 

My parents live in my house but have separate living quarters and buy food separately. I am not sure if it matters but they are divorced and retired.

 

My husband and I listed my parents as dependents on our last tax return, but we're unsure if this was correct. Apparently, they cannot be claimed as dependents as their information wasn’t used for tax calculations. However, their names are stated on the tax returns we submitted.

 

The question is: In form i-864, part 5 “sponsor’s household size” do I need to count them as part of my household? Do I need to include both – my mom and dad if I file only for my mom?

A household is a group of people who live in the same housing unit, regardless of their relationship to each other.

That means that whoever lives in that apartment\house with you regardless of their relationship to you is part of your household. 

But that question is very simple and i don't even see them asking how many people live with you.

2.- is asking for yourself add 1

3.- is saying add 1 for your spouse

4.- add how many children you have

5.- i guess it ask if anyone else depends on you (they just want to see if you can afford them all) if a relative lives there and that person pays his own shared of the bills, i wouldn't count them!

05/17/2013 - NVC received package.
05/24/2013 - NVC Sent package to Ecuador embassy (I called and they told me that)
05/28/2013 - Received mail from NVC notifying they have send my package to Ecuador.
05/31/2013 - Ecuador Consulate mail package to my fiancée.(I've already scheduled the interview before this)
07/15/2013 - Visa approved!
11/30/2013 - POE (smooth process, she was done in 1 hr)
12/21/2013 - We got married!
12/24/2013 - Applied for SSN

03/27/2014 - Sent out AOS, EAD, and AP
04/03/2014 - Received NOA for all 3
04/08/2014 - Received appointment for Biometrics
04/30/2014 - Received RFE (need proof of income)
05/06/2014 - Did Biometrics appointment
05/07/2014 - Sent RFE
06/14/2014 - Received EAD/AP combo card
07/10/2014 - Notice of Potential Interview Waiver Case

02/23/2015 - Opened a Case Inquiry "Outside Normal Processing Time"

03/09/2015 - USCIS responded with a letter, and pretty much said "keep waiting, we'll get to you"

03/24/2015 - "Card was ordered to be produced"

04/03/2015 - Greencard in hand!

12/22/2016 - NOA

02/06/2017 - Biometric appointment

12/13/2017 - Received "Notice of Removal of Conditional Basis of Lawful Permanent Residence" APPROVED!

Surely random roommates renting house / apartment unit together typically are not in the same household?

Correct. They are part of your household if you claim them on  taxes as dependents or are children ( not living w you) but are obligated to support.

 

You could have great granny , auntie Sue or Joe Shmoe bunking w you…they are not counted as household members.
