Have 10 Year Green Card - Received Reminder to Submit 751

Something strange happened today and I'm wondering if this has happened to anyone else. I received my IR6 10 year marriage based green card this year (in January 2024). At the time of approval, I had been married well over the 2 year mark so it wasn't issued by mistake. All of the info on the card is correct - listed as IR6 with a 10-year expiration date. Today I just received a "Reminder to File Form I-751" notice from uscis. I'm assuming this was sent by mistake but I'm very concerned that I am mistakenly listed as a conditional 2 year resident in the uscis system. Even if this was the case, why would I receive this reminder 9 months after the initial approval as opposed to closer to the 2 year mark - doesn't make sense at all.

 

Anyway I'm a bit stressed out over this, as I thought we were all set with this green card situation. I'm curious if anyone else had a similar thing happen? Specifically, did anyone correctly receive a 10-year green card and then receive a reminder for the 751? Did you ignore it? We called uscis but they didn't really have any answers. They just took my info and said they would escalate the question and have someone call back within 30 days. In the meantime I'm kind of freaking out.

If you have an IR6 green card and have also received an I-751, it means that you initially received a conditional permanent resident status based on your marriage to a U.S. citizen, and you have successfully filed Form I-751 "Petition to Remove Conditions on Residence" to remove the conditional status and become a full permanent resident with an IR6 green card, which specifically applies to spouses of U.S. citizens; essentially, you are now able to live and work in the United States permanently without restrictions related to your conditional residency. 

 

Key points to remember: 

 

IR6 green card:

This signifies that your permanent residency is based on your spouse being a U.S. citizen. 

 

I-751 form:

This is the form used to remove conditions on a conditional permanent resident status usually obtained through marriage.

Greetings and thank you for the reply. My issue is that I was never classified as a conditional permanent resident to begin with. I already received my full 10 year IR6 permanent resident card when my adjustment of status application was approved because I had been married longer than 2 years at the time of approval. But today I got a letter saying I need to submit an i751 to remove the conditions on my green card. That is why I’m confused because I don’t have a conditional card. My card says ir6 and has a 10 year expiration date. My 797 approval letter from January also states it is an IR6 approval.

This is a mistake, you're not the first person to receive such reminder in error.

 

You can file FOIA to get all information about you.

Something similar happened to me - I received a 10-year GC instead of a 2-year GC after my AOS interview. I treated it like a mistake and filed I-90, and then close to the 2 years I filed a Removal of Conditions case. Then I had 2 cases pending, and earlier this year, I got two 10-year greencards - one for each case, lol. I just created a post about this, since I'm not sure about my 2 GCs.

 

Regarding your situation, I think OldUser might have had a good suggestion, but I'm not familiar with filing FOIA. I wonder if the alternative would be to file ROC if you are still within the filing timeframe if your 10-year card were a 2-year one? Ugh! Gotta love immigration!

It might save a lot of effort to contact your Congressman's office first.  The immigration liaison can almost certainly get an answer faster, more easily, and more reliably than your solo efforts will yield.  Try that and let us know.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
