MANY QUESTIONS ABOUT N-600K Please HELP

Good morning Everyone! Sorry for the long post.

 

Im here because I have a question  questions about the N600K,

First:  I applied for a CRBA in the Dominican republic for my child, Im a us citizen but I didn't live in USA after the age of 14 that's why I got denied got the CRBA, now I'm applying for N600k and I'm gonna use the 5 years physical resident of my mother who naturalized in 2011 after 20 years of green card, here is my 2 questions:

 

First: The application has a question that says: was there any prior application for citizenship or for a u.s. passport for the child? If y put yes a Yellow Warning comes up and says:
The child may not be eligible to file an Application for Citizenship and Issuance of Certificate Under Section 322 (N-600K).

If an Application for Citizenship and Issuance of Certificate under INA 322 (N-600K) was previously filed on behalf of the child, and the child received a decision from USCIS, you should not file this application again. USCIS will reject any newly filed Application for Citizenship and Issuance of Certificate (N-600K). Review the decision notice for more information.

If USCIS denied your prior Application for Citizenship and Issuance of Certificate, you may be eligible to appeal that decision using the Notice of Appeal or Motion (Form I-290B). If the time for appeal has expired, you should submit a motion to reopen or reconsider using Form I-290B. Review your decision notice for more information.

If you are seeking to replace a lost or stolen certificate, you should submit the Application for Replacement Naturalization/Citizenship Document (Form N-565).
If you have previously filed a passport application on behalf of the child, note that the child is not eligible for issuance of a Certificate of Citizenship under INA 322 if he or she has a valid, unexpired U.S. passport.

Because of that,I don't know if the answer is YES or NO, as the CRBA is a consular report of birth that documents that a child was a us citizen at the moment of born, and not an application for citizenship like N600 or N600k , and the warning says nothing about CRBA, so should I put YES or NO?

 

My second Question is:

 

As I said at the beginning of the text, my mother naturalized after 20 years and she got her naturalation certificate, the proof of 5 year phisical resiency include her own naturalation certificate, plus more than 5 years of income tax, possibly the IRS quaterly report, the seals of the passport of all her traveling, but not much more as my mother didnt have anything on her name because she always lived with her sister, that means she doesnt have bills on her name or any contract, nesides she worked as nany, cleaning, that means she received everithing cash, not banking account, is that enough proof of us physical residence?

 

And at last does my mom need to go to the interview? she doesnt speak english.

 

 

 

I tried to pay a immigration attorney but they denied to answer that question because I was not going to do the process  with him.. I don't have enough money to cover the process with a lawyer, I'm doing it by my own.

The people you've tagged also haven't been on the forum for a year or so. You can look at their profiles and see if they are still active members or not.

Don't forget, you only get one shot at N-600K. You already got denial for CRBA. Maybe saving / getting a loan for a good lawyer is not a bad idea.

Naturalization cert is not good proof of physical presence in the US. Taxes is half good as can be filed from anywhere in the world. Did mother work in the US?

Yes in many factories and like house keeping, her last income tax was in 2011, i dont think that in those years the remote work was available.

You can try, but you need to get absolutely everything you have, not the bare minimum. If she can somehow get letters from those employers confirming her employment, that would help.

I have her passport Stamp as well, because she traveled alot because we was in the outside country.

This could be somewhat useful, but there wouldn't be stamps of her leaving and coming back to the US.

Maybe FOIA with all records from CBP could help.

Does she have emails or any other copies of flight reservations or boarding passes showing she had return tickets from and to the US?

No, that was long time ago, but she does have insurance cards.

It's a difficult case. USCIS is unlikely going to approve N-600K based on "it was long time ago". I'm not an expert or lawyer, but I don't see enough evidence for successful outcome.

 

I already mentioned some of the ways to get extra information such as reaching out to employers, getting log of entries / exists from using FOIA. You can also get some affidavits from neighborss / people she was in close contact while living in the US. If there are school records for you etc that may help.
