Timeline

hi guys!! well im a little bit confuse here regarding the annulment papers that i will bring for my interview. what i have here with me now are...

a. FINALITY (certified true copy from the local civil registrar).

b. DECISION (original)

c. NSO certificate of marraige with annotation.

am i missing something here? i read somewhere here that i still need the DECREE OF DECLARATION OF NULITY OF MARRAIGE. is the FINALITY & DECREE OF DECLARATION OF NULITY OF MARRAIGE different from each other? do i have to get a copy of the decree?? if i have to, where will i get it? thank you!!

BTW i just checked my schedule at the USE website like 20 min ago. surprisingly i have my MEDICAL & INTERVIEW date!!! wooohhhooooo good luck to all of us!!

I've gone through the same road as you are going through now. You know, with all the annnulment documents and proofs. It does look like you have all the necessary government issued docs to prove the termination of previous marriage.

Do you have a passport now? In my case I had to process/submit documents to DFA to issue me the correct passport. It should be the same name as listed in your birth certificate (spelling should be the same) . So I had to submit annotated Civil Registry issued Birth Certificate and annotated NSO Marriage Cetificate that was Annulled. These things sort of took days to process. You know how it is in our country.

Anyway, I wished you all the luck in your interview.

My husband is annulled. He only gave me the annotated from NSO that we obtained just recently for our IR1 application, however we have a certification from the Local Registry dated in 2005 and the decision also in 2005 just in case. My husband did ask NSO if this enough, she said it should be. But of course, the lady was from NSO and not from USEM.

Have you thought of obtaining a copy of your Certificate of Finality from the court where your case was heard? Although the certified copy from the Civil Registrar is the same as the one from the court, I believe a copy from the court is better

No. My husband didn't think we needed it, and I personally is clueless about it. When I asked him about Finality of Annulment, he just gave me the one he got from NSO (as you would call it the annotated version). Is the NSO not enough then? Sorry for asking too much questions. :crying:

The USEM might ask for court papers proving the annulment. The requirement specifically stated a DECREE of the same, and that is the one coming from the court.

On second thought, although we are talking about annulment here...I have been married with him for 2 years, has a one year old son... are these not enough to prove that his previous marriage is annuled and voided? :dead: and that ours is a bona fide marriage?

You have apoint there but to play safe just bring all the papers that the USEM will need. It is better to have them in case they will ask you, after all the validity of one's marriage or its invalidity for that matter can be best proven by documents . Wont hurt if you obtain one from the court. Goodluck okay and pm us anytime .

thank you for the insight and yes i do have a passport already. so i guess im all set for my interview RE: the annulment. but just curious if i do still have to get a copy of the DECREE OF DECLARATION OF NULITY OF MARRAIGE

Have you thought of obtaining a copy of your Certificate of Finality from the court where your case was heard? Although the certified copy from the Civil Registrar is the same as the one from the court, I believe a copy from the court is better

i have not thought of getting a certificate of finality from the court. thanks for the info, i will go get a copy of that this monday just to be sure. you know what they say here in VJ. its better to have lots of supporting documents. better to be sure than to be sorry hehe

PS if anyone here knows anything about the DECREE OF DECLARATION OF NULITY OF MARRAIGE, pls PM me or tell me if that is different from the FINALITY. and if ever where can i get that. thanks again.

Ryz,

The Decree of Nullity of marriage is the DECISION of JUDGEMENT from the court annuling your marriage while the Certificate of Finality is a certificate coming from the court after the DECISION has become final and executory. .this happens when the SOlicitor General has not filed an opposition to the decision of the court annulling the marriage. So get BOTH copies from the court, the DECREE which is the Judgement or Decision and the CERTIFICATE of FINALITY.
