Hi Everyone, 

 

My dad was recently denied his immigrant visa due to crime of moral turpitude.

 

He committed bigamy in 2006 and received a suspended sentence. His record has since been expunged and his police record is clear. 

 

The consular officer in Jamaica provided him papers and it says to file a i601 waiver.

 

Does anyone have experience on this?

 

I have been doing a lot of research and this was committed over 18 years ago and he has never had any issues prior or since. 

 

I don’t believe I have extreme hardship so I’m confused on that part.

Is that needed for this specific case?

 

I understand I may need to contact a lawyer.

Who is the qualifying relative for an I-601....and I would hire an attorney for a waiver.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am a USC and filed for my father. He is currently overseas and has never been to the U.S. I assume I would be his qualifying relative as his daughter.  
 

Based on the instructions below it does not seem like a qualifying relative is needed in this case.

A Cimt is unusual compared to the situation we normally see.

 

Just want to check that he did disclose the situation on his DS260?
