Appleblossom : I've had a green card I stayed more then one year in morocco I've lost my green card and now I'm planning to file for the DV Lottery is that gonna increase my chances to be picked up?

No. You'll have the same chance as anybody else applying. 

 

Have you actually relinquished your GC though?

No I haven't relinquished my GC it was stolen at the airport of casablanca when I landed here so I could't go back to USA without it.

Now im looking for ways to immigrate back to USA that's why Im choosing the DV lottery.

So why not apply for a replacement/get a boarding foil so you can go back to the US?

 

If you are still a LPR, you're not eligible for a new green card from the DV lottery.

I think I'm no longer LPR since I stayed more then 12 months in morocco that's cancel your Green card, even though it's still valid until 2030. 

Second, I couldn't afford the fees for a boarding foil. Tragic I didn't plan this to happen.

A boarding foil would have been much cheaper than another green card. 

 

But regardless you're still a LPR at the moment. Do you have anybody in the US you could get a replacement green card sent to? I'm going to ask that a kind mod splits your questions off in to your own thread rather than hijack the OP's any further.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can’t apply for the DV lottery, you’re not eligible as you’re already a green card holder. You either need to file to give that up before you can apply for anything else, or get back to the US asap. The latter would be much cheaper but you need to get moving on it.

You are absolutely still a LPR. Forget about the DV lottery and concentrate on getting back to the US on your current LPR status. Additionally, DV is a lottery and it's got a guarantee. Your current LPR is a guarantee you'll get back in but it won't be simple so find some money to charter the course.

 

I see two options for you. There might be other options too.

Option 1 - File Form I-131A, pay the fee, get the boarding foil at the embassy.

Option 2 - (If possible) Fly to Mexico or Canada, and try to enter the U.S by land border. Tell them your story about GC stolen. Wait to be grilled and processed. Hopefully, you have a paper copy of GC or know your A-number.

 

[Not adding this as an option] I believe to file for a replacement for a lost GC using I-90 you need to be inside the US due to high possibility of being called to do a biometrics which won't be possible for you. 

 

Other advice for you.

1. Act fast

2. File a police report for missing GC. 'Might' need it for GC replacement down the road

3. Borrow money if you are broke.

Just because you lost your physical green card doesn't mean you lose your status as a U.S. lawful permanent resident (LPR). You are an LPR until a U.S. immigration judge determines your LPR status should be rescinded, which requires a hearing, personal service by USCIS, you would know if that were happening or had already happened. 

 

Were you only outside of the U.S. for longer than 12 months because you lost your physical green card and were therefore unable to return?

I don't think a boarding foil is an option now as the OP appears to have been outside the US for more than a year. 

 

No. 2 definitely the best option. But I would also get the OP to file the I-90 in case he's asked about it - biometrics can be rescheduled if they are required, but if he at least has a receipt number for the I-90 that might be useful.

Good catch for option 1. Seems SB-1 visa could be the possible alternative to option 1 but higher risk of being denied.

Yep, not ideal. They could get an ADIT stamp though, requested online and then sent to a friend's house - friend can then mail it to them.

The loss is not automatic. 1 year is just the general cut-off before when CBP might seriously question it with the presumption that you've abandoned it (so the burden of proof shifts to you that you planned to come back).

 

Absent you filing an I-407 you can generally try to enter US on a green card and see what happens. CBP can do one of three things:

1. Admit you back in as an LPR - great

2. Try to pressure you into signing an I-407 and leaving

3. Parole you for removal proceedings - then it depends, if you are eligible to readjust (e.g. you are married to a US citizen who can re-sponsor you) you can generally do that then, otherwise you have to convince the judge that you didn't abandon your permanent residency.

Obviously not a straightforward option since the green card got lost.

 

Bit late for the boarding foil. I do agree with nastra30, gather up any documents you can (police report of it being lost/stolen, anything to prove that you have something to come back to in US like rental agreements, mortage, bills, paychecks (or if you got let go or put on some kind of sabatical something from your employer that you can get your job back once you've sorted this mess), kids birth certificates and school records, freaking Costco membership you still pay for, discord messages where you lament over losing it and not being able to afford the fee for the I-131A), fly to Mexico/Canada, go to the US border checkpoint and sell your story that it was never your intention to abandon it and it all happened due to a chain of unfortunate events outside your control.

 

Then basically the same stuff as above applies. They can admit you back in they can parole you back in (where you'll need to convince a judge instead). Just don't sign an I-407.
