Hi all

Need your precious advice and opinions to this question. Can we work for a Canadian employer from USA and get paid in CAD? When do we have to inform CRA ?

Is it the date we entered USA on IV but still have a job in Canada ? Or is it the date we actually left our job and completely cut all the ties like quit job , sell the house etc?

The day you enter the US you are a US PR and no longer a Canadian resident. For CRA they will be told when you file your taxes and mark your entry date on your tax returns.

If your employer is willing to tax you as a non resident employee then yes. Make sure you also no longer use the Canadian health care system, even though you are taxed for it. As you will not be a resident of Canada and can no longer use the system. Yes it sucks as you will continue to pay for it. Now if your employer offers dental that is separate from Health Canada and you can use those benefits.

If you have a house to sell it is best sell before your endorse your visa. The tax hit, and hassles from moving before the sale have been talked about year after year.

Can you file this with cra and have them adjust the taxes ?

im trying to sort it all out as well - wanting to maintain a residence and job in Canada (PR in USA ) then apply for duel citizenship to give me options ;)

I'm not sure, I've just seen others say the employer needs to change your tax status.

If you're working in the US, you are tax resident there, regardless of where you're paid. And you'll have to file a US tax return.

Are you a Canadian citizen?

What if we are keeping job and our house in Canada. And later come back to Canada then sever ties and finally move out ?

CRA will go by the date you cross the border to endorse the visa. That is the date you will mark on your exit taxes.

So that means there is no way other than filing non resident taxes and continue working for Canadian employer...

Wont we be a factual resident then instead of non resident if we still have some ties in Canada.

Well they can contract you out and then you do something that way. I don't know how that part works but that was something other members have done.

Oh no they will treat you as a non resident to squeeze every last cent they can out of you. Especially when you sell that house.

After moving you need to file this form: https://www.canada.ca/en/revenue-agency/services/forms-publications/forms/nr73.html
asking CRA to determine your residency status.  When you get the determination, you can provide it to your Canadian employer with it (you might be EI or OAS exempt, for example).

However, before moving, or making any decision, I would consult with a fiscal accountant.

Thanks I will consult with an accountant to get more clarity.
