Help filing out form I-864 (Merged threads)

Hello, i am full time employed and self-employed (freelance designer) at the same time.

my w2(full time job) has income over 80k.

I had 7-8 1099s from my employment. 

 

I am submitting IRS tax transcript and employement verification letter with my salary.

 

Do i have to submit ALL 1099s for all last 3 years?

OR

is it fine/enough to upload:

1 - IRS tax transcript for last 3 years,

2 - 2023 W2 (has enough income to be sponsor)

3 - Employment verification letter?

*No 1099

 

any advise is appreciated.

Timeline

If you are using transcripts from the IRS you do not need to include W2’s or 1099s as that information is included in the transcripts.  You can include your employment letter to show ongoing employment.

thank you for answer! it makes me feel good.

 

just to confirm, i filed my 2023 taxes "married filing seperatly" 

i had W2 and 1099 last year, and i was full time employed (W2) and some freelance(1099)

 

For financial documents:

  1. 2023 IRS tax return transcript,
  2. Employment letter with salary
  3. Last 3 months paychecks

is this all enough? just checking before submitting, so much thanks.

Hello again guys! I was wondering if you could help me fill out our form i864 again.

I think I know where we screwed up, and I just want to make sure that we get it right this time.

My hubby is my sponsor (no joint sponsors), and he's sponsoring only me. No parents, no siblings, no child.

 

  1. So on part 3, item 29 we should write "1", right?

  2. Then, off to section 5: persons you are sponsoring on this affidavit, 1.

  3. What confuses me is the section "Persons NOT sponsored in this affidavit". What should we put in "yourself"?

  4. And also, if you are currently married, enter 1 for your spouse. Yes, he's married to me, but if I put 1 in there our household size becomes 3(but we are only 2, wife and husband). What should I write there?

 

Would somebody be so kind so as to help me, please?

I downloaded my 1040 tax transcript from IRS website,

form is the 24a-c asking for total income on page 2, or adjusted gross income on page 3 of the transcript?

 

please see screenshot for what i am referring to.

on the transcript there are two incomes, one for total income, another for adjusted gross income.

 

which number/field should be entered on form i-864

It states .. do not count anyone twice. Because you are sponsoring your  spouse, you place “1” in box 1 

Because you have already counted your spouse in “box 1” you do not must “1 “ in box 3 That would be counting him twice 

 

in the section “others” You fill in and that apply to you and are members of your household as per the instructions  and  leave the other sections  blank

So you fill it out for him (he is actually your sponsor and the I-864 is a sponsors document). Under 5.3 "Persons NOT sponsored in this affidavit", I think you don't enter his spouse (you) because in fact he DOES sponser you.

 

But I even believe you (he) has to file the I-864EZ instead of I-864 if he can answer all three question below "yes"

1.b.  I am using my own earned or retirement income, which is documented using Internal Revenue Service (IRS) Form W-2.

1.c.  The sponsored immigrant is the only person immigrating based on the underlying visa petition.

See bold above.  You have that backwards.  He cannot use the I-864EZ because he can't answer all three questions yes.  Further, anybody CAN use the I-864.  Nobody "has to" use the EZ version, ever.
