AOS from K3

Can someone else please call up USCIS (toll free 1-800-375-5283) 8am to 6pm Mondays through Fridays to see if we get the same response?

I will try and call them tomorrow. Also, my wife arrived on a K-3 visa in September 2005. She never received a welcome letter or a green card.

Due to a wrongly informed civil surgeon and the IRS not getting my tax transcripts to me, I was delayed getting her AOS filed until now.

I wrote my lawyer about this and she replied, "Did an immigration official tell you this? If so, get it in writing." I didn't tell her that it was "Zyggy" who told me...she is still skeptical that you can't adjust status after coming this far

I called up USCIS again today, and here's the new reply (which appears logical this time):

Yes, once the beneficiary enters US on a K3 or K4 visa, he/she is eligible for Adjustment of Status.

It won't matter whether the IR petition is at NVC or has been forwarded to the US embassy (country of origin). Since the person entered on a K3/K4 visa, he/she can file for adjustment of status. He/she need not go back to the country of origin to show up for the interview.

I also asked if I have to prepare a new set of I-864 (Aff of Support) documents for the Adj of Status (I submitted one to NVC for the IR petition 3 months ago). The lady said she cannot give out info on this, as regulations change with time. She asked me to call back when the family is about to file for adjustment of status (meaning, its too early for me to ask- so I have to "cross the bridge when I get there").
