Hi, 

My husband had initially filed for an adjustment of status in the US and had left the country to go to Canada on the approval of our lawyer. She did not tell him that he would not be allowed to re-enter. The entire process was thrown out when we got to the border and he was not allowed back in. We got a new lawyer and had to change the process to consular processing. We have been in separate countries for a year now and there seems to be no changes or moves in the I-130. Has anyone else had to go through this, where they changed from adjustment of status to consular processing? And if so, how long did it take to approve the I-130 and move on to the next steps? We filed in Aug,2023. My husband is a medical student and has had everything on pause and missed 2 cycles of residency applications. If anyone can give some insight, that would be great!

It's about 14 months for I-130's at the moment, so you're nearly there. The next step will depend largely on your (how long you take to submit documents, etc), and the consulate - Montreal unfortunately has quite a lengthy wait for interviews. Is your husband Canadian originally?

Was he born in Canada? If you're quick with paying fees and submitting docs, then it'll be about 6 months from the I-130 being approved to his interview date as a rough guide.
