Didn’t include my 3year old daughter in my petition( IR1) at uscis. What is the outcome if I want to file for her now.

Why do another DNA test? What do you intend to say on the affidavit?

Do a dna and state I had doubt she was mine that was why I didn’t include or declare her in my case

That would be lying, and immigration fraud. And frankly a stupid idea particularly with an ex that can easily prove you knew about her before you applied for your visa.

No doubt the Consulate will request a DNA, and will probably raise a few quesions.

Yes, exactly. I wouldn't contemplate filing anything without a good lawyer personally, you could be risking your own status.

The US Citizen step mother can petition child (It's faster) but make sure they have all their ducks in a row and get written notarized permission from mother. Get papers drawn up and get it notarized at the US Embassy to avoid any wahala. It's still going to take an about 2 years or more to get child here but faster with US Citizen filing.

So I have a question. What papers are needed to drawn up. Also in case of the father not mentioning the child’s name or existence during his case what will be the outcome when he decide to file for the baby after getting his lpr

6 months after birth. By then my wife already filled my case which was at uscis and we didn’t put her name on that form.

You knew the child was yours when you went for interview.  I don't think it was a mistake, as you say.  I think you didn't want to admit to the consular officer that you were married to one woman, but that you had a six month old by another woman.  Especially in a high fraud consulate.

I think you need a good lawyer.  As others have said, you might have endangered your own presence with an intentional lie.

Do you have legal custody of the child?  I assume not from your post and replies.  Legal custody will help your case, plus a sworn, notarized statement by the child's mother that she will allow the child to immigrate to the US without her.  A good family law attorney in your home country plus a good immigration attorney in the US will be needed to successfully navigate this.  Hopefully you have a good job to pay for all this and to financially sponsor the child.

Are you married to the child’s mother back in your country?
