Oh my goodness, I am getting SO frustrated!

Obvisously on my father-in-law's tax transcripts it doesn't list the adjusted gross income anywhere. What are we gonna do about that? We need to know it to put in the I-864, right?

And I still don't understand how we can split up my mother-in-law's and my father-in-law's income on those transcripts since we only want to use his, not hers. What are we gonna do about that? Use his W-2s? What if he doesn't have those anymore? Can we use a "wage transcript" or whatever it's called?

Yes, the income of the husband and wife is lumped together, so you need the W2's to split it apart.

I've noticed lately that a lot of VJ'ers are sending the W2's with the tax transcript (even though it's not required) because some people have been getting RFE'd for lack of them. I would try to obtain them if I were you. His employer should be able to provide a copy if all else fails.

I called the NVC and I think I know what we have to do now:

Basically if we only wanted to use my father-in-law as a sponsor, we'd have to find out his income only by W-2s. That probably is a big headache since he doesn't have those.

If we used my mother-in-law as well, this is what we have to do:

On the 864:

Nr. 23: He puts his anticipated income of this year and transfers it to 24 a.

Nr. 24b: He puts her anticipated income and puts their total ancticipated income on 24c. Also gotta check 24d.

Nr. 25: Most recent is 2006 and so on. He puts their joint income.

Then of course mom has to fill out the 864A:

Part 1 and 3 are for her, part 2 for him.

10 is anticipated income again.

11 is joint income again

I think I got that right. Can anybody please confirm?

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

I agree with this, if someone is sending a photo copy of their return - it is required. Jasmin is using a transcript (or was originally).

"If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy".

Again, father and mother both had to sign that I-864A.

But you say now that they do not "leave" - live? - in the same residence? I'm going to have to read the requirements for Household Member again before writing anything more.

Ok to sum up

sponsor - less than 125% so we decide to use joint sponsor, the sponsor father and mother, (that do not leave in the same house) they file taxes jointly so mother main sponsor (her income is more than 125% poverty line) signs the I-864 form, father signs I-864A (which is only a contract with a family member to use his income too as they file jointly).

Hope I made it more clear... and I hope I got it right
