Tourist visa denied.. worried about the reason.

Hi, I’ve been thinking about this for a few days and feeling a bit worried. I wanted to have my husband visit me while we await our I-130 as I’ve heard some people have been approved while waiting. However he applied for a tourist visa in Jan 2024 and was denied as he said he was planning on visiting with his brother and had no family members here (true we were just snapping/texting). We got married in July 2024 and he went in Sept 2024 at his 2nd attempt at a tourist visa - this time mentioning our marriage. The embassy worker didn’t give him a chance to speak and just said he’s “lying” because he mentioned last time he didnt have any family members in US (which he didnt). I’m worried this was written down as fraud and he will never get any visa. I’m not sure what the embassy would have written down for his denial?

The vast majority of tourist visa denials are due to lack of strong ties to home country.  Ever person who applies for a B2 visa, by law, is already assumed to have the intent to stay in the US.  Having a spouse inside the US is an extremely strong tie...to the US.  I assume that was the reason for the denial.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The embassy worker has just told him he "lied" - do you think she may have submitted that? i just dont want him to be falsely accused of fraud.

Yes, every word he said is typed in by the officer and his comments and his reason for denial.

 

Its extremely rare for these types of lies to affect an I-130/K-1 visa since the intent is to immigrate anyways.  But recently there was one such case. 

 

However, you do not really know what he said during his 1st or 2nd interview, or what the officer dug up on him.  Neither will tell you.  If it really as simply as lying about having a gf/financee or knowing someone in the USA during his first interview, most likely that will be forgiven so I wouldn't worry about it. If it is something more insiduoius, you'll find out later ...

Yes, it's reasonable to assume they would put some sort of reason or info about said denial. If the officer thinks he is lying then that is most likely reflected in their records.

 

At the end of the day it doesn't matter what any of us think or if you think he was "falsely accused", the officer who refused him had reason to come to the conclusion that he is lying and therefore that impacted the decision & unfortunately, nothing can be done to change that.

 

Can this potentially impact future visa attempts? Yes. It is possible.

Will it completely ruin/doom the attempt? No, of course not.

There's no way to really know for sure. It's all about the evidence and information you provide in each/every visa process taken.

 

As others have previously mentioned; misrepresentation and lack of ties to home country are very common reasons for tourist visa denials.

Any sort of deception at a consular interview is not recommended, and can come back to bite you later.  Obviously he was planning to visit you had he gotten the visa.

 

There is no way to know at this point if it will be an issue for an immigrant visa, but going forward, just be truthful.
