NEED ADVICE. WE WROTE TO USCIS TO WITHDRAW K1 PETITION DUE TO CHANGE OF PLANS BUT NOW WISH TO CONTINUE. WHAT CAN WE DO?

Timeline

Hi all. The subject of this post almost says it all but a little more details. We applied for our K1 visa (submitted petition) around the end of July. Some situations occurred in the past couple of weeks (including work commitment) which led to the petitioner reaching out to USCIS to withdraw our petition, but now things are clearer and we wish to carry on with the application again. Can we reach out to them yet again that we want to carry on with the petition (even us know that that's a really weird move), if we do reach out to them, won't it affect our chances?? Will they even listen to us this time?
It's just a few days between the petitioner reaching out to withdraw and now, and the status of the petition remains the same on the USCIS website, although we know that takes a time to change even after the status of application has actually changed.
We haven't reached out to them yet about our change of mind as we are thinking of the best way to approach this but we literally have to continue with the application. Advices, opinions and comments are all welcome. Thanks all.

Thank you. Explaining the answers to questions about it hopefully won’t be a problem as we are very genuine and should be able to explain everything. I appreciate your response

Also how long would you suggest we wait for filing again? Just your opinion. Thanks

I see no reason to wait.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You said yourself that it was. Withdrawals are irrevocable and the petitioner sent a request for withdrawal. So it was, uscis just hasn’t  processed the request yet. 

You have to start all over again. 

 

Send in a new petition and make sure you check the box asking if you ever applied before.

What SalishSea and Yareth said is correct - just because USCIS has not updated your status acknowledging the withdrawal request, does not mean it won't be withdrawn. Many people experience significant delays in this update/acknowledgement; even several months.

 

A withdrawal request cannot be taken back after it has been submitted. Withdrawals are irrevocable.
