Hello,

 

My husband had his interview on August 1, 2024 in Rio. They said everything was approved, however 3 weeks later they emailed saying that they needed to investigate more their system and if we had any further documents to send, to email. We did email more to prove that the information in their system was not correct. Because of their "investigation" they changed the status from approved to refused. This happened on August 29, 2024. Yesterday, September 25, they further updated the "last case updated" date but it still says refused, however this time around they did not send any email. Trying to understand why they would update the date if the status is still "refused"...

It's normal.  If someone opens the file, it triggers a last update entry.....but it does not mean they have sent you an email.  All visas go through some form of administrative processing after the interview.  Visas will not be issued until all admin processing is complete.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What I don’t understand is why they would open the file and not to something about it, or maybe they are doing (whatever they don’t communicate clearly). Maybe it’s a good thing that they’re looking at it even though not documenting or emailing anything new to us…?

That's how I see it.

We are left to wonder how long the AP takes and what steps are involved. The lack of communication freaks one out.

How'd you know? Embassy told you this? 

 

And how did you know that the information on the Embassy system was not correct (from your intial post). Did they share what the issue was? I just don't understand how you knew.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

They said the background check revealed felony and we know very well that is not true. But after I sent them an updated background check they did not say anything else. Just updated last Friday the new updated date but did not email us or ask for anything else.

But still says refused.

Why did you have to provide that?  They do their own background checks.  Are you referring to a police certificate?

They said their system showed a felony but that is absolutely not true. They said they were investigating but if we wanted, we could provide further documents. So we did. Then after 4 weeks, they updated the “last updated date” but still says refused and no new email to us. I’m just praying they don’t need any more proof and discovered their error and are processing it soon…

I have heard of extended refusals and administrative processing due to background checks....but not this specific issue.  I hope you get it resolved soon.
