I was denied employment on my EAD. I applied for a job as certified flight instructor. The General Manager told me he can’t hire me as I am not a US citizen. I was looking in the FAR and couldn’t get any info. I was also looking in on USCIS website about employment no info. Does anyone know where to find citizenship requirement to be employed as certified flight instructor

Some jobs are only open to USC's, usually due to security clearances.

Perhaps its thats companies policy no matter what.

The law prohibits discrimination in hiring on the basis of citizenship status, so my first guess is that maybe it has something to do with directives from the Transportation Security Administration.

I would ask the GM to explain to you where that rule comes from and dig into it a bit.

Friend who works for IBM, has TSA as client, who require Citizens to work on their contract.

This is a small flight school were I would be working as a flight instructor. It is not a government job or a contractor. The regional airlines which are hiring require only proof of employment authorization. I looked on TSA website no info. I will call to TSA to see what they say.

I would look for a more accomodating employer.

(h) U.S. citizens and nationals [...] A flight school must determine whether an individual is a citizen or national of the United States [...] prior to providing flight training to the individual.

(1) U.S. citizens and nationals. To establish U.S. citizenship or nationality an individual must present to the flight school his or her:

(i) Valid, unexpired United States passport;

(ii) Original or government-issued certified birth certificate of the United States, American Samoa, or Swains Island, together with a government-issued picture identification of the individual;

(iii) Original United States naturalization certificate with raised seal, or a Certificate of Naturalization issued by the U.S. Citizenship and Immigration Services (USCIS) or the U.S. Immigration and Naturalization Service (INS) (Form N-550 or Form N-570), together with a government-issued picture identification of the individual;

(iv) Original certification of birth abroad with raised seal, U.S. Department of State Form FS-545, or U.S. Department of State Form DS- 1350, together with a government-issued picture identification of the individual;

Irrelevant. This is about STUDENTS - not hiring a legal permanent resident as an instructor.

I respectfully disagree. In my opinion they got started somewhere in Afghanistan in the training camps of Al Qaeda. Flight Schools were simply the last step.

That only applys to students and if you are not US citizen you need to regsiter with TSA. I am allready a flight instructor with US certificate.

Just a question to find out more info. So you got certified as a flight instructor in the US? When and where? Your AOS is still pending so you are technically not a legal permanent resident. Your status as a PR is pending. They might not be able to hire you for this position because of that, even with your EAD. I just find it curious how you got trained in the US. Did you come to the US on a student visa first?
