Denied because we enaged too earlier, -- help!

My fiancee got denied for K1 visa.  We engaged two days after I arrived in Cambodia, so the consulate said we engaged too fast. #######.  Consulate handed a one sheet with "x" mark on section 221g.  Not asking for additional documents.  This is unethical.  Please help, What should we do now? I am clueless.

I-129F Timeline (Cambodia Consulates):

2024-02-08 I-129F Sent w/personal check of $535
2024-02-12 NOA1 (California Service Center)
2024-05-13 RFE (Additional Evidence)
2024-05-28 Sent RFE
2024-05-30 RFE Delivered
2024-06-04 NOA2 (Approved in 113 days from NOA1)
2024-06-07 USCIS Sent to NVC
2024-07-16 Got email from NVC
2024-07-16 CEAC status "In Transit"    
2024-07-23 CEAC status "Ready"
2024-07-24 U.S. Embassy in Phnom Penh emailed Packet 3 to petitioner.  Instruction for Packet 3/K Visa

2024-07-30 Fiancee went for Criminal certification in Phnom Penh, pick up date 8/12

2024-07-29 Fiancee paid visa fee at Cathay United Bank per visa instruction, total $530 for K1 & K2

2024-07-31  Booked Interview date Sept 19 @ 8:30am.

2024-08-01  Fiancee called IOM to book medical exam.  see link and requirement below. 

2024-08-08 Medical exam appointment @8:30am total cost almost $500 for 2 people (vaccine, blood work, and x-ray).  No need to bring 6 photos size 4x6cm.  IOM does all that.

2024-09-19  K1/K2 Interview @ 8:30am

Medical Exam: Six (6) photos size 4x6cm, packet 3 letter, Identification Card, Passport, Interview confirmation page, and COVID vaccine card at IOM.

This doesn't sound like a denial....does it say the petition is being returned to USCIS?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yep.  That is a denial.  It will expire at USCIS.

Timeline

Time to spend more time together, marry, and file for a spousal visa, imho.  That K-1 application is dead.  The only (and very, very unlikely) option is to ask for a review before it leaves the consulate.  The consulate is not obliged to review or give you any more information.  Likewise, USCIS will not give an appeal.

@appleblossom  My first visited in Cambodia and saw her in person but we talked for almost a year after my cousin introduced us.

OK, that is unusual then and I can see why that would look suspicious. Generally the advice for a tough consulate is to meet several times before applying. 

 

I agree with the above, marry and try again after visiting more.

I think marry is the best option. Another long waiting :(  Do I need to do a traditional wedding or can go to court and get marriage license when I visit her again? or they need to see wedding pic etc and marriage license is not enough?

Timeline

As the others have said, the bottom line issue is the lack of time spent together  through visits/physically in person, even if you married, that visa will also require you to provide evidence the relationship is genuine etc etc - just like the k1 does, even more so because the relationship then is at the next level of actually being married.

 

So jumping straight into marriage asap just to file the spousal visa could just result in the same issues; you need to strengthen your situation/case by spending more time together, more visits so that will essentially improve how the relationship is perceived as by USCIS and immigration officers.

 

After some more visits and more time spent physically together, collect proof and evidence alongside those visits, then approach the spousal visa as an option. 

 

Otherwise you risk having the same thing happen via spousal visa, either process they're going to want proof the relationship is genuine and real, and that's why they like to see multiple visits over time.
