CR-1 to IR-1 change in CEAC portal after two years of marriage?

It may or may not change on the portal.  In the end it is the US entry date that makes the ultimate decision, and since you are married for over 2 years you are entitled to a 10 yr GC after entry on a spousal visa regardless of what the visa says.

Thank you! Are you sure that it might not change on NVC portal? A lot of folks here are saying that theirs did get changed to IR1. Thanks again!

It may change, and honestly it should, but my point is to not worry about it as it is the entry that makes the final decision, and even people that show IR1 on the portal sometimes erroneously are issued 2 yr GCs.  If for some reason that happens to you, you can get it corrected at no cost to you via an I90 filing.

It doesn't matter if it changes or not.  It doesn't even matter if the CBP officer stamps "CR-1" in the passport at POE.  The 2 year vs 10 year card will be determined by USCIS using your marriage certificate and entry date.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And if you ultimately receive a two year card, file an I-90 with no fee, and get it corrected.  This is really nothing to worry about.  You were told, it "might not" change in the portal.  Then you asked if the person was sure it "might not".  Now you know whether it changes or not is irrelevant.  If you want to be sure to receive the correct visa, mention it to the Consular Officer at your interview.

Facts are cheap...knowing how to use them is precious...

It's USCIS who issues Green Cards.  NVC or even the Embassy has no authority over whether a Green Card is CR1 or IR1.

  • May 06, 2021: Submit AOS, Financial Docs and DS-260s
  • May 14, 2021: Submit Civil Docs for Stepdaughter
  • May 21, 2021: Submit Civil Docs for Wife
  • June 25, 2021: NVC review for Stepdaughter, RFE submit additional Doc
  • July 08, 2021: Wife Documentarily Qualified by NVC
  • August 31, 2021: Stepdaughter Documentarily Qualified by NVC
  • September 15, 2021: Received Interview Date from NVC, October 05, 2021
  • September 22, 2021: Passed physicals at Saint Luke's Extension Clinic
  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail

That is correct, but the Consulate or Embassy has authority over the visa category at issue.  If the visa is IR1, it's unlikely the green card will be wrong, but still possible.  This is not about authority.  Only mistakes can impact the final result.

By law I know IR-1 is what it is. Why I am asking is because I am concerned about some clerical mistake which might be causing this. I-90 is free but has a long wait times. And you know if something happens for 9 folks but not for the 10th one, the 10th one will naturally get concerned

The only clerical error which would matter is one which takes place at USCIS after entry into the US.  and you have no control in preventing that. Worrying is of no value.
