My wife and I had her (I-485) green card interview in Atlanta today. We were not approved yet because the officer said that her J1 visa didn't say weather she was subject to 212e 2 yr Hrr or not subject to 212e 2 yr hrr. Her 2019 didn't have either box checked either. He gave us an envelope and told us that we needed to send them proof that she isn't subject to the 2 yr hrr within 90 days for the application to be approved. She came here as an au pair and shouldn't be subject to it. Does anyone know where I can find out if she is or not. It wasn't even in the INS data base. Do I need to contact the department of state?

VJ is a family based immigration site, not a general immigration site.

I don't even know an hrr is.....?

According to Phoenix Processing office they will take 5 months to process, lets see if they keep their "promised schedule".. (hahaha yeah right)

09/08/2010 ... Touched. BIOMETRICS CAME TODAY! (notice date/mailed on: 09/03/2010; biometrics for 09/22/2010 at 11 a.m.)

11/03/2010 ... Interview 11 am!! (PASSED!!!!)

12/30/2010 ... Oath notice (dated 12/22/2010, mailed on 12/29/2010) for 01/20/2011 at 8am!! FINALLY!!!!

Maybe try contacting the consulate who issued the J-1.

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Here is a site that will help you figure out if your wive is covered by 212(E) and help apply for a waiver if she is.

I believe that you'll need to get a judgement from the Department of State to prove that she isn't covered by 212(E).
