My senator in CA has offices all over the state besides their DC office. The office that handles immigration concerns is in San Diego, but they aren’t getting back to me so that’s why I reached out to the DC office to get someone else and figure out what’s going on.

Oh ok. Mine got back to me and pretty much said I am in administrative processing and there is nothing they can do.

In a similar boat, but only a week into this. Sent Passport last week, radio silence since then. No updates of any kind, no response to emails, no confirmation that they have the passports except the courier receipt of confirmation. Our problem is that we live in the US on a different visa and opted for consular processing because it would have been faster, which it was, but now my son is a a freshman in university and is forced to take a leave.

 

Not sure what to do but to wait.

Can you use the second passport to travel back to the US?

Yes you can use the second passport to travel. However it's not an easy process to get the second passport.  You basically have to prove what happened to your first passport. They suspend it until you return back to Canada and then it does destroyed and first passport reactivated

Did they ask for your passports? Did you get 221g? Did you submit other documents? When was your interview?

Here is my timeline:

 

Is it possible to move to AOS from consular processing if I have gone as deep as completing the interview with the consulate and sent the passports for stamping (but been waiting for 2 weeks). Below are the details of my case:

 

Canadian Citizen, currently holding an E-1 Visa till Jan 2026

EB-1C

PD July 2001 (from a previous I-140 approved)

I-140 approved November 2022

Case sent to NVC in Jan 2023

Documentarily Qualified in April 2023.

Got Interview letter letter in August 2024

Interview on September 13 2024, got 221(g) for missing Canadian Police certificate for my Son and since the EB visas were exhausted and they could not issue any more visas till October 1

Got PCC and sent it in 2 weeks (end of Sept 2024)

Got email from Consulate to send passports in October 2024, sent them the passport on October 20.

No response from the consulate, total radio silence, meanwhile my son who is a freshman in College in US is missing school time and it is worrisome, so trying to find ways for me to get him back. I am reading some horror stories of people waiting to get their passports back since months. One thing to add is that the consulate officer knows that we live in the US and my son is a freshman in college, this is the reason why he did not keep the passports when he gave us 221(g)

 

Any advice would be appreciated.

It looks like you are actually ahead of me in line. Because from what it seems you are out of administrative processing.  Did you get an email stating you were done administrative processing?

No I have not received any email regarding administrative processing and my status has never moved to AP, it continues to show "Refused"

Ok refused is the same as administrative processing.  They sent an email requesting your passport.  I think that simply means you are done the administrative processing and you are in the final stage. I belive you are ahead of me in line

I think it should take them 2- 4 weeks maximum to get you going i believe.  But on their website it states 60days.

Mine says refused as well. But I heard refused is administrative processing and I sent them emails which they responded stating I just have to wait

Honestly I don't know. I mean they have my passport since July 15th but they requested your passport. So maybe I am ahead of you. Try applying for a second passport if you don't hear from them in a week. My suggestion

Hello everyone. Just wanted to share some info. Maybe it will be somebodies choice in the future.  So, i have submitted my passport On August 13th, 2024 and still nothing. Therefore i decided to get another canadian passport to be able to travel.  Got my spare passport a few days ago. You can get it as soon as next day.  You need a prove of travel (i.e. airline booking), prove that your passport is at US Embassy (printed an email from embassy stating that I have to send passport and also carrier-in receipt from post office). Paid $170 CAD for 1 week processing. Was told at Passport Canada that after I will get my passport back from the embassy, I must give up my spare passport and show them the old passport for reactivation. Thats it.
