Timeline

Hey all, just a very quick question as I prepare our paperwork for AOS:

 

If my fiance is receiving a SSN/card prior to us filing and we provide that number on the forms, should we also be requesting a new card be issued?  My understanding is that the one he gets prior to our wedding will be conditional, I want to know if we have to request a new one for the EAD, or if that will be issued automatically upon approval, even if we say no on the form.  Thanks in advance!

Our Visa Journey

7 Aug 23: I-129F petition mailed.

9 Aug 23: NOA1 arrives approx. 1 week after mailing with this issuance date.

1 Mar 24: NOA2 (v 1.0) issued.  Time between NOAs, 205 days (6 months 23 days).  NOA2 exp date 30 Jun 2024.

8 Mar 24: NVC received case

1 Apr 24: NVC inquiry, and provided case #.

8 May 24: NOA2 (v2) issued.  Same USCIS #, same case #, new exp date of 7 Sep 2024.

May-June 24: many inquiries sent to NVC as well as the embassy, as we see other K1s with later NOA2s are sent to Johannesburg before us.  Involved senators to investigate, refused to assist without expedite request.  Email to White House end of June 2024.

2 Jul 24: case leaves the NVC for Johannesburg.  Total wait time at NVC, 123 days (4 months 1 day).

5 Jul 24: consulate in Johannesburg receives case.

8 Jul 24: Packets 3 & 4 received, medical and visa appointments scheduled.

23 Jul 24: medical appointment with Dr. Brauer (Cape Town).

8 Aug 24: visa interview with CO in Johannesburg, 16 days after medical.  Visa not issued because medical packet wasn't filed yet.  Passport and birth certificate kept by CO.  Total time from NOA1 to interview/approval, 365 days (exactly 1 year).

13 Aug 24: email to consulate due to CEAC still displaying "Application Received" status, instead of the predicted "Refused" or "Administrative Processing".

14 Aug 24: consulate reply, they are currently processing visa.  CEAC status changes to "Approved" (no refused or AP statuses prior).

15 Aug 24: CEAC case status changed to "Issued"

20 Aug 24: K1 visa in hand!

13 Sep 24: POE, Detroit (DTW)

17 Sep 24: Applied for SSN successfully

The number will be the same regardless

So I don't think it'll be necessary

The only condition on the card is it has "allowed to work with DHS authorization" or whatever printed on it

Which I believe you would want to get removed once he becomes a citizen (if that is the plan)

Always apply again for REPLACEMENT CARD on both I765 and I485.

The SSN that comes with EAD is restricted while SSN that comes with GC is unrestricted. You'll want to have an unrestricted card so you can use it to work along with your DL instead of having to provide your GC as proof of eligibility to work. (You should never WANT to show your GC. DL + Unrestricted SSN is best.)

 

Also you said "getting" his card? How do you know? Has it shown up in your informed delivery? Applying doesn't mean approval. It's VERY common for K1 SSN within 90 day applicants to get denied because of not following procedure to apply. 

Also Also, if you do not apply on your I485, you'll have to go in anyways to get an unrestricted card. Save yourself some gas.

Good Morning. I was reading your comment, and I'm somewhat in the same boat. My wife and her daughter have gotten their SS # when they arrived.

 if I'm correct in saying this, when they are approved for their GC.. or EAD..  they should reapply for a new SS card ?

That is what we did when my wife got her GC (we didn't bother with doing it after she got her EAD as the GC came only a month later).  This allowed us to remove the DHS note and also change my wife's name in the SSA system.  Back then there was no box to check on the I485, or the I765, but even so, I would not trust that the SSA and USCIS area actually coordinated.

I just got off the phone with my wife. I had asked her what it says on the SS card. She said to me that it says ( not authorized to work ). Now with saying that. she has gotten her EAD card.

She can, but I don't think they will remove the DHS note with just the EAD.  I would wait for the GC.

Which I believe you would want to get removed once he becomes a citizen (if that is the plan)

The wording can be removed much earlier than than this, once GC is in hand (even conditional)

It isn't perfect, but why would SSA issue a new card when it's the USCIS card production facility issuance of GC production that initiates SSN card production?

Still saves you a trip IF IT WORKS 90% of the time instead of not applying for one on I485 AT ALL.

That's silly.

Are you certain it is the production of the card that triggers the SSA, and not something that happens before the AOS is decided?  I am not confident that federal government agencies function efficiently let alone logically.

I am absolutely certain.

How do I know? 

Because if you call SSA headquarters in MD before you get the "Card being produced" update on your account, SSA will be clueless that you even have an application in. Call after and the SSN will be in production too. And I'm talking minutes difference.

It's a waste of time NOT to check the box when the odds are extremely high that the system works as it's supposed to. 

 

Now perhaps you are talking about the EAD and GC coming so closely consecutive that SSN doesn't have time to know if they are issuing a restricted card or an unrestricted card????

 

I've never hear of anyone who filled out their EAD/GC form correctly requesting a replacement card and SSA not being competent.

Most fill it out incorrectly or are just impatient to wait the few extra days it takes to come and yell the sky is falling when they are the reason it did.

the SSA card production triggers when USCIS adjudicator officer approved the EAD/GC application. i would always check the box when i filed for other people. super easy, noone need to go to SSA office. while for my own case because my stupid lawyer's paralegal think she knows everything, she didnt check the box. once i got my GC i have to go to SSA office and because of DHS incompetency to update my status, i cant get unrestricted SSN card until 2 months 2 weeks later.

I'm very confused by which direction this thread has taken.

 

I will assume that it is best procedure to request a new card on our paperwork.  Of course we do not have have the conditional card in hand yet, but the whole point of this discussion is to plan for contingencies.  I encourage people to entertain the hypothetical not just for our personal journey, but for anyone who comes across this portion of their AOS planning in a similar vein, and is curious what to put.
