Why K2 still not getting EAD while K1 already got for 2 months?

I am the K1 mom, and I tried to expedite EAD in the K2 uscis account that the K2 daughter needs to work for financial independence for in-state tuition but got denied. K2 did her biometric with her Dad's (my ex) immigration case before and had two A-numbers, one from K2 and one from her Dad's immigration case. Can that be the problem? I did send another letter to USCIS to use the A-number of K2 case. Then I got a weird reply.

 

"We have reviewed your inquiry and need to advise you that we are not able to provide the information you have requested. Specifically, it is not clear that you are the applicant of the requested information or have the legal authority to act on behalf of the applicant.

Due to rules set forth in the Privacy Act of 1974, we cannot discuss the issues or share information concerning the immigration status of the applicant in this case, nor can we confirm that he or she has any action pending with U.S. Citizenship and Immigration Services (USCIS)."

 

Can anybody advise what is the meaning of this USCIS response? Do we wait or do anything? Thanks a lot!

How old is the K2?

If they signed their own forms they are the petitioner/applicant of their case and are the only one's eligible to ask about their case via phone or preferably e-request or Ask Emma.

 

PS. A K2 will never have their own A number until they have their first immigration benefit approved such as EAD, AP or GC. 

 

PSS. If you are a K1 and your daughter is a K2, how could your husband be an immigrant? (ie. You keep speaking of your husband's immigration case). Only USCs can petition for K visas. A GC holder cannot.

Thanks a lot for your answer. K2 is 20 years old. We did send an e-request to her USCIS online account together. I see two A-numbers for K1 and K2 separately on the letter from the Consulate, so I input the A-numbers for me and K2 in our AOS files. Mine was the same when I got my EAD and AP combo card. K2's dad is my ex-husband. He had an immigration case before with my daughter as a dependent, but it didn't go through.

You filed in June it seems.

 

Now I have seen some outlier cases where EAD is received in a couple of months, I think the normal is still 6 to 8.

 

So she has a bit of a wait.

 

Expedites well why not and you never know but this does seem a strong reason.

Then they should respond accordingly if she did it through her account.

That is a NVC CASE number not an Alien Number. 

K1s receive their Alien number upon Visa Approval. 

K2s do not receive their Alien number until their first SOLE immigration benefit is approved.

 

A K2 visa approval is a derivative visa so they won't get their own Alien number yet. 

 

To ask questions of USCIS for a K2, THEY will use their Receipt number for the application in question. They do not have an Alien number and should not reference anyone else's Alien Number as the K2s immigration process is completely separate from the K1's.

Sorry if don't understand any of that.

I'd leave it out of future questions as it has nothing to do with your path to AOS and will only confuse.
