F2A - CSPA please advise

Hi,

My father (Permanent resident) filed I-130 for my younger brother in October 2021. At the time of filing my brother was 20 years old and the petition took 15 months for approval. The case was approved in February 2023 and the priority date on chart A & B was current. We filed DS-260 immediately and waited till now for interview. I am curious to know if there is any hope my brother will be covered under CSPA? Any similar cases?

 

Priority date - Oct 2021

I-130 approval -Feb 2023

DQ - April 2023

Interview - September 2024

Since F2A was current in February/March 2023 and only in April started retrogressing it looks to me like your brother got lucky and should be locked in at CSPA age 20 since you filed for the visa immediately.

Thanks for your response. We received NvC welcome email immediately in February 2023 and we submitted the document's and paid fees within a week but it took time NVC to review the documents and call it DQ in April 2023. Are we still good? I will also update in this group after the interview.
