Timeline

I have been looking at some timelines and I noticed that most RFE's are received before the biometrics appointment. Is this true or did I just only see those? I'm asking because I checked one wrong box (8.61 public charge question) and I am wondering if they would even send an RFE if that is the only thing wrong with my filed documentation. Apparently I am by default subject to it and I already provided the additional info they ask there in the package like household size and income. Anyone heard about this particular oops in the form and RFE or not? I saw one topic on it, but the OP had a list of things in the RFE so I can see where they would include that part than too.

 

Maybe someone has an educated opinion on this?

Depends on your particular adjudicator and how they handle it.

There would be no accurate answer to your question as each adjudicator can do what they like and send an RFE based on any errors in their guidelines.

My advice? Log it in your "there is nothing I can do about it now so oh well" file and "hope for the best but anticipate the worst" where "an RFE is not even close to the end of the world".

LOL no I know, absolutely not the end of the world and I have the right filled out page already ready to send in in case I do get an RFE. I guess I'll just wait and see what happens. Thanks.

Just curious, why would you say 100% sure it will be an RFE?

 

I know everyone gets biometrics and obviously I didn't check hundreds of timelines, but the ones I did check had RFE's listed before biometrics were taken, which is why my question.

RFIE (initial evidence) occurs at early stage if any.

 

RFE (additional evidence) can happen any time in the process and right before decision.

 

RFIE typically is issued for obvious missing evidence, like missing marriage certificate in marriage based GC case.

 

RFE occurs after IO studies the case further and has additional questions.

 

At least this is my understanding.

 

Ahh well that explains it. Well I'll probably get one but I hope they will skip anyway. I am fairly sure everything else is in order and complete so who knows.

The ‘no’ response implies you claim exempt eligibility and are one of the listed groups , while none of your submission has such evidence of being an asylee , vawa etc.  It also means the additional related questions will need a response ( liabilities/assests, education..etc).

 

Dang, you are tough to persuade…😂 ..so I won’t even try explaining that you could preempt the RFE with a corrected relevant page .

🤣 Please do! If I can do that I'd rather do so instead if waiting for an RFE! Where would I send that and what do I need to include?

Draft a cover letter titled Supplemental Filing for I-485/ Request for Update and Correction , list  case # , A# , name

 

In above ref adj, the following items need to be changed on form I-485: page x, part y, item z updated response Yes ( list each question)

Enclosed please find a corrected page x , of form I-485 revision date xyz. 
‘Please note the original submission was an unintended error .

Sign date and send copy of receipt notice Mail it to address on that notice and if you have an online account you can also upload .

It’s the first three letters of the case number which signifies the service center. IOE is assigned to those that are converted into online cases, usually I-485s are but not all. If you have an IOE case then you get an access code. If you have a regular service center, then you can’t upload things or view documents online.
