U4U vs. K1

Hello all...

 

Ok, so I do have an offense that falls under Adam Walsh act. I understand the hoops I will need to jump through (waiver, supporting docs,etc).

 

My question:    Is the U4U a better chance for me with this criminal history as compared with trying for a K1 ?  Does U4U have same requirements?? I've heard that K1 can take years once they see the offense.

My lady lives in Ukraine. I am in USA.

U4U is a form of HP and not a way to move permanently to the US. But yes she could apply for U4U and it would give her, well currently, 2 years and it also comes with benefits.

They are totally different, I assume you will be the sponsor for the U4U I 134A which is any event meaningless and has minimal requirements.

 

K1 means you want to marry and have the intent to adjust.

It would not effect U4U, K1 absolutely.

What is the end goal?  As @Boiler said, U4U, is way different than a K1 visa, but if the end is to get married and eventually become an LPR, the AWA issue will come up at some point during AOS.

The end goal would be marriage.    I guess what I need to understand or think about is, for the K1, AWA comes up immediately. A waiver and full explanation is needed to get approval. And I've heard K1 AWA cases take forever to even get "touched".     If I do the U4U, then try for AOS, are they going to hold me to the exact same standards? Would they deny the AOS?

Yes,  They do background checks on sponsoring spouses during AOS. Very, very good attorney territory, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

LPR stands for Legal Permanent Resident commonly called a Green Card holder.

I would do U4U anyway even without the AWA issues.

 

The intent then would be to marry and adjust, now for that you need a Lawyer, there was a lady who posted here on Thursday who is I think in a worse situation that you, but married and what do they do if there is no route?
