Parental consent affidavit notarization in Morocco

Hello everyone. my fiancé (American 24years old, I, Moroccan, turning 21 in December) is filling the k1 visa. We met a few weeks ago and be stayed here for 8days. We couldn't get family photos or anything because it was our first meeting and wanted to see how it goes...after he returned we decided we would like to marry and file for the k1 visa, not the cr1 because he can't stay here for a long period as he has business to watch. However im afraid that this will be a red flag at the embassy and will get us rejected. I have heard of parental consent affidavit and that this could help with our case, however I'm not sure how it would work, given that notaries here (Morocco) don't speak English and might refuse to notarize documents made in English? I would appreciate any type of information. Thank you in advance.

affidavits from friends and family are typically the least compelling evidence. and frankly don't do much good. Cause anyone can write an affidavit and theres nothing to say what they write is true.

 

USCIS wants to see evidence of multiple meetings (flight itineraries, hotel bookings, tickets from outings you've taken together). Pictures as well but those things are better evidence than just pictures. I wouldn't expect an approval with very little evidence that you seem to have.

 

in my opinion you would be better off spending more time together in person, gathering additional evidence, before filing for the K-1 visa. it would save you more time, money, and energy than filing now.

 

for the spousal visa he doesnt have to stay with you for a long period of time. you get married then "consummate" the marriage (which for USCIS just means being together in person either at the time of the marriage or after marriage has taken place). a lot of people utilize the online marriage that Utah has for this. You can live apart during the process. there is still having to prove it is a bonafide relationship. which still requires evidence of such.

hey thank you for your response. i guess the affidavit wont do much. We have pictures together, and I sent pictures of your outings to my sister on whatsapp during the time he was here, would sceenshots help? he also was talking about his trip with me to his family, so I was wondering if the messages can act as evidence. he will be coming back in a few months, but we wanted to fill the visa papers to save time.

Mesages similarly to affidavits are also not the best evidence.

My fiance and I included screenshots of our messages to each other, but I doubt it had any sway on our petition at all.

 

Really your best evidence is the flight itineraries, hotel bookings etc. and pictures of you together during these outings.

 

I personally don't think messages between you and your sister would help much.

 

There's nothing stopping you from starting the paperwork and gathering together the documents and stuff you'll need, but in my opinion you should wait until you have much more evidence before you submit the petition.

More time together in person, documented with passport stamps, original boarding passes, hotel receipts, a few photos will help.  The more visits to see you the better as this is a difficult consulate for K-1s.  The other important thing is that the US citizen needs to be asking the questions, as he will be the one to file the I-129F petition, not you.  If you are doing this process without the help of an immigration attorney, your US boyfriend should become very familiar with the process and the challenging road ahead.

My husband is from Morocco so we have a lot of experience with the consulate there. In addition, myself and another VJ member have a FB group for Morocco/US visas specifically. 
Keep in mind that the ONLY thing they will look at is your one short visit of 8 days - anything you bring to the interview does NOT need to be reviewed, so they will assume that he did not meet your family. Meeting a 2nd or 3rd time before filing does nothing but make both your case and your relationship a stronger one. 
In addition, the wait time for an interview for K1 is around 6-9 months after USCIS approves your case. There are plenty of people in our FB group whose K1 journey is much longer than a spouse visa because of that - some are around 2 years from filing until interview. 
Also keep in mind that if your K1 isn't approved (if they dont believe your relationship is real based on one visit of 8 days and not meeting your family), there is no appeal - you start all over again with the CR1. 
Its hard on many people to get married in Morocco - but it doesnt take THAT long - we got married in 5 days there and you could always consider the online Utah marriage too. It seems like people do what they want to do, so you've likely already made up your mind - but a year or two waiting for a K1 that may or may not happen is a huge risk to take based on the minimal evidence you have now.

If you get married before you file anything, you're no longer eligible for a K1 visa, full stop.

 

If you're of an Islamic persuasion, you can't do a Nikah and apply for a K1, either. 

 

The only option at that point is a CR1 visa.

8 days together, and already deciced you want to marry?   Not a good idea, take time to know each other,   let him get to know your family.  Months of chatting dont mean much, screen shot pics arent helpful.

Morocco is a tough embassy regardless how strong a releationship- evidence there is,   so take time to be prepared, get to truly know each other.

 

You cannot marry & file for a K1 Visa, Not even a Orfi marriage or a Nikah marriage.
