Good morning,

My wife received Covid shots prior to coming to America in 2022.  We completed the I-693 form and went to the civil surgeon.  No issues were brought up during the visit but I received a message that my wife is required to get the updated Covid shot.  We are trying to get pregnant and want to know if this qualifies for a waiver.

Thank you.

1. A K1 who completed their medical and vaccinations overseas does not need an I693 or a new medical. It's your responsibility to ensure your DS3025 is MARKED complete and IS COMPLETE. Ensure you've examined it for completion.

2. You received a "message" from WHO?

What kind of "message"?

An RFE from USCIS?

A spam email from a spammer?

A message from the civil surgeon that redid the medical for no reason so now they are playing on your gulliblilty to get you for more money for a revacccination?

Or a simple reminder that the Covid vaccine doesn't last forever, and if you desire to be protected, you'll can get another one?

3. Please fill out your extremely BLANK VJ timeline. It says you married your K1 in 2011. Your stats will help no one.

Thank you for the reply and the alert that my timeline is outdated.

My wife came here on a tourist visa as we did not plan to get married during her visit.  We successfully adjusted the visa to a spousal visa.

She was required to get Covid shots prior to coming to the USA in 2022.

The message was from the civil surgeon.  She stated everything was in order, but my wife needed to get the updated Covid shot.

Thank you.

i helped someone to file for AOS on January 2024. she was pregnant at that time she did i-693 (december 2023), the surgeon cant/didnt force her to get covid booster and just put a note that she (the beneficiary) is pregnant.  file the medical with AOS package, she just got approved in August 2024 without interview.  but in ur case ur wife is not pregnant so i dont know how u are going to get away with that. can only file the waiver to find out the result.

https://www.cdc.gov/immigrant-refugee-health/hcp/panel-physicians/vaccination.html#cdc_generic_section_9-covid-19-vaccination-requirement

"Applicants must receive one dose of the COVID-19 vaccine if a dose is due at the time of the immigration medical examination.

For the purposes of the immigration medical examination only, applicants who have not received a COVID-19 vaccine dose in the 12 months prior to the date of the exam are considered due for a dose."

https://www.uscis.gov/tools/designated-civil-surgeons/vaccination-requirements

"You must complete the COVID-19 vaccine primary series (for example, 1 or 2 doses, depending on which vaccine, in adults; 2 or 3 doses, depending on age and which vaccine, in children) and provide documentation of vaccination to the civil surgeon in person before completion of the medical examination."

"Q. What will happen if I refuse to receive one or all of the required vaccines?
A. Tell the civil surgeon if you do not wish to receive the required vaccines or a particular vaccine. You should also tell the civil surgeon the reason you do not wish to receive the vaccine(s). In this case, a waiver may be available to you, but only under the following circumstances:

  • You are opposed to all vaccinations in any form– a waiver may not be granted if you only object to specific vaccinations;
  • Your objection must be based on religious beliefs or moral convictions; and
  • The religious or moral beliefs must be sincere.

The form used to apply for a waiver depends on the adjustment category under which you are seeking legal permanent residence status. For example, refugees and asylees seeking adjustment of status should file Form I-602, Application by Refugee for Waiver of Grounds of Excludability. Individuals seeking adjustment of status based on an approved Form I-130, Petition for Alien Relative, or Form I-140, Immigrant Petition for Alien Worker, are required to file Form I-601, Application for Waiver of Grounds of Inadmissibility."

I'm not sure if "trying to get pregnant" would count as a moral conviction

I do not see the correlation, I do not remember this ever coming up as a medical problem.

If the spouse has already had multiple shots and they have not hindered her in currently trying to have a baby, then having the required booster will not hinder any future baby making endeavors. While it is true that said vaccine can temporarily in some cases effect the length or flow of a cycle, this can be related to a complex reaction between hormones and stress response. The risk of body damage due to becoming sick with COVID is high, especially for some women with pre-existing gynecological conditions. Temporary cycle changes can happen for any vaccine, medication, illness, stress event, anything or nothing at all. There is no evidence in preventing pregnancy. Consult with your spouse's OBGYN for further medical confidence. Your reasoning will not qualify for a waiver.
