So if your file was not open then how did you book your Medicals.

 

What I know is that Embassy uploads the Medical file which the doctors access through a portal and only then they book your appointment

Nor will I, but I’m willing to bet that if my husband were to require medical care in Ontario after activating his US IV, OHIP coverage would not be denied while we are back in Canada temporarily, packing to move permanently.  End of story

UPDATE: 11 days after sending my passport, the consulate themselves emailed me requesting an updated medical (I expected this as it expired on October 15 and they received my passport on October 10) and my passport. On one hand this is super annoying because I’m going to have to fly to Vancouver again for it and spend more money, on the other hand I am absolutely ELATED because this means I am so close to finally obtaining my visa!!

He would never be denied treatment, he'd just be billed for it, the same as any other non-resident.

Timeline

This process in unreal and infuriating to say the very least. I’m now seeing multiple people get their visas who interviewed way after my fiancé AND they had to have additional background checks. My fiancés passport (he didn’t even receive ds5535- has been sitting at the consulate since April. I’ve emailed multiple times with only generic replies. I emailed my senator’s office (California) a month ago, they completely ignored the first request, I called and submitted it all again, and it has been 2 weeks and still nothing. For those who retained an immigration lawyer, did it resolve absolutely anything? I just don’t understand what is happening.

My spouse’s interview was on March 15, 2024, and she was asked to submit a DS5535 which she submitted the next day. Except for a few updates, there has not been any progress. 

She will be visiting her home country in February 2025. Will that delay her case? Also, does she need to inform the Montreal consulate about this trip after she returns (since it was not included in the DS 260 that she submitted)?

You do not need to update any travel history after the submission of DS-5535 nor it will delay your processing. Keep the thing simple.

He absolutely won't be billed a dime for simply activating an immigrant visa. 

 

I see a lot of silly posts on this topic.  I would advise to consult a tax expert before declaring yourself a non resident. 

 

But no, a simple activation will not result in that.

One becomes tax resident in the US as soon as one becomes a LPR.

 

Ontario law says that the place of residence for OHIP eligibility is determined by, amongst other things, "anticipated future living arrangements". If you've become a US LPR and then returned to Canada briefly to wrap things up before moving to the US permanently, then it's clear that those "anticipated future living arrangements" aren't in Ontario. 

 

If you have a re-entry permit and are returning to Ontario for longer, then it would be different though.
