K1 -- Anyone have recent experiences with Sex Offender Registry?

I am wondering if there are any recent experiences with being on the registry and wanting to bring girlfriend on K1 visa, or a wife on a spousal visa. I know it is far from easy, but I have a therapist who will back me up and he is very experienced with the courts and respected in my state. He said he had success a couple years ago with this. From the wording of the Adam Walsh Act in terms of waivers, it is supposed to be based on if you are a risk to the person you are getting the visa for. My charge is a misdemeanor. I am no risk to my adult girlfriend and we want to marry. We lived together abroad and we speak every day via video chat. I don't think we have missed a day ever. My charge is the lowest charge with the lowest Tier of registration (having downloaded some underage porn during a period of depression and porn addiction.).  Judge me based on that if you want, but I was never suspected or accused of anything more than that. They found about 1 GB of legal porn downloading from torrent sites and just a little of it was illegal (6 files total). Most of it was never even opened or viewed, it was just downloaded and there was history showing that some stuff had been downloaded in the past in huge packets of files and deleted before anything was even opened. I know it sounds weird, but porn addiction is like that. it is a dark place and you download freaking everything even if you don't look at any of it. Sorry for the gross and sad details. I was in a bad bad bad bad place. Anyway, all that would be attested to and there are court records of course backing it up that I was not a risk to any child in my life, etc. was completely compliant when i was on probation... not one mark against me and they really do try and trip you up while on probation, but I never came close to breaking a single rule. Even immediately after the 30 days I spent in jail, I could own a computer, be on social media, encounter kids in my day to day life, or at work (when I managed a restaurant), be around family who have kids, etc. Further, my son's mother and my son will vouch for me any day as a person and as a father. I have no other criminal issues, worked my butt off to send my kid to a great private school, then college, dedicated myself to family and friends, etc... no one has anything bad to say about me. I could go to Europe (travel is allowed on the registry but her country is problematic with that) and meet her there to marry (then try and bring her on a spousal visa), or I could try and get a K1 visa. My understanding is that the interview with the embassy person involves making sure the person knows about your history, which she does. She knows everything...they can talk to her all they want about this and anything. Plus, if their concern is having kids in the future --  we are not going to have kids. I am 51 (with a 27 year-old son already) and she is young enough to still have kids if we hurried and did so, but she is 100% sure she doesn't want them. She basically had to raise her sisters and a cousin, and she wants no part of parenting ever again. So that concern is not an issue. I am MORE than willing to get a vasectomy if that would help perceptions. It has been in my plans that last few years anyway but I had an appointment cancelled during covid and never got back around to it.  Okay, sorry... long winded... but does anyone on here have any experience of late with waivers to the Adam Walsh Act in situation such as mine? or in the ballpark?  it seems like if anyone would get a waiver, it would be someone in my situation.  It would be heartbreaking to end a 6 year relationship because of this. It would really ruin my soul again and I am not sure how I would go forward.. .and more importantly, it would destroy her. I have to let her go if this doesn't work out. And no, even though I am allowed to move abroad and travel abroad, her country would not allow either probably.

AWA is a toughie and I think I can only remember one successful situation, I do know it is not DIY and most fail.

 

I would definitely look to see how her Country views this, I assume you have been  able to visit there?
