Husband and Adult Kids addable as Derivatives?

Hi.

I recently found out that my aunt, a US citizen, filed for a petition under F4 for my mom in 2010. However, they did not include any derivatives. Would it still be possible to add me (21 yrs old), my brother (17), and my dad (married to my mom) as derivatives while the petition has not been approved yet? We are from the Philippines.

Would my brother and I still fall under CSPA even if the petition gets approved, let's say, in 2030?

I would think it will be another 10 years

Your Brother will be 27

 

Now CSPA applies but how long did the I 130 take to be approved?

Hello!

Apologies, it took me some time to find out. The petitioner was sent a letter with a notice date of April 2010 saying the petition has been approved and sent to NVC. Priority Date, I found out, is Sept. 2009. This means we can only subtract 8 months from me and my brothers' ages?

This means we are incredibly far away from being considered below 21, once the visa becomes available, correct?
