Hello. I am confused about one question on the form and would really appreciate your advice. It's the "if you have sponsored any other persons on Form I-864 who are now lawful permanent residents, enter number here." So about 4 years ago, I was married to my ex whom I sponsored, but also did my parents as joint sponsors. He isn't a US citizen yet. Now fast forward to today and I am petitioning for my new husband, but as the only sponsor, so if I answer "yes" to this question, does it mean that now my income has to match the poverty level for 3 people as opposed to 2, and that I'm not just sponsoring on this form my new husband but that ancient lol husband of mine is included in this new form? I was counting the poverty level threshold for 2 people (me and my husband), so this question on I-864 threw me off and now I'm nervous that my current income of $36,500 (which is good for 2 people), might not cover 3 people. Could you please advise on this? It seems unfair that my ex-husband has to be stuck in my current sponsorship.

Hi. I have a question about I-864 question as I am petitioning my husband. It's the question "my current individual annual income." I am not sure how to calculate this because from February I began working for Uber East, Doordash & Grubhub, and I made different monthly income for the three apps, which is not W-2. Just to give you an example, for this February, I made $5,693 for Doordash, Uber Eats $3,475, and Grubhub $1,162. So for February, I made $10,330, while for March, I made different amounts for all the three and made $7,456, for April it was $8,000 and the different income for the apps different as every month. Anyways, so how in the world would I put a set amount of "my current individual annual income" would be if it's not like I am getting $5,000 every month and can calculate what I will make from February to December? Also, I own a paid-off home which I am renting out so I'm also a landlord for two years and my 2023 tax return, my total income is $36,350, and this year, I'm still charging the same rent amount, so for my landlord income, should I just include my 2023 tax return as this year's landlord income or how should I prove my landlord 2024 income? Thank you

Hello. I am petitioning for my husband who is out of status in the US for green card. I just wanted to make sure that I got the right forms filled out and that I am not missing any other forms from submitting all at once. So far, I have completed I-130 (me), I-130A (him), I-485 (adjustment of his status from out of status to legal), & I-765 (employment), & I-864 Affidavit of Support. Is this all the forms required by me for my petition or am I missing something else? I'm not interested in travel doc as that's not a requirement, but an option. We aren't planning to travel outside of the US just yet. Please advise. 

P.S. It seems that some of these forms require the same supporting docs, but even though I have collected the necessary docs, they are all in one copy to be sent, which I'm assuming is ok, since it's not like I have to send the same doc 4 times just because I'm submitting those several forms all at once, right? I also have 2 passport-type photos for both, and I'm guessing it will be enough for all those docs? I'd appreciate your help please so that I can send those out.

The packages, even though mailed together to USCIS, will be split up when received.

Compile each as though it is distinct and stand-alone from all the others.

Each should contain its own full requirements.

It's based off your 2023 IRS transcript. On your 2023 IRS transcript, go to the line that says "Adjusted Gross Income per computer." That's what you're looking for. If the number that is there is above $26K, then you are good. Pick it and write it exactly the way it is in your I-864.

 

Now, if you hadn't made enough for 2 people in 2023/ the number on the aforementioned line is below $26K, then you'd use a monthly average of your 2024 Uber Eats et al. But you made $36K last year. So, use your 2023 IRS transcripts information.

Furnish EACH form independently, no matter how repetitive it looks. Though sent as one via UPS, FedEx etc, they'll be handled by different processing centers.

 He came with a tourist visa once, then left, then came back and overstayed his visit the 2nd time.

Hello,

I am a US citizen who petitioned for my spouse a month ago. I sent I-130 & I-130A along with the supporting docs and got our I-797C receipt # already. I heard that I can either wait to hear back from the USCIS requesting I-485 or I can submit it before their request. I'd like to now submit his I-485 AOS, I-693 (medical exam), I-765 (employment), and I-864 forms all together. Looking at the site, it seems that all these forms should be sent to one center/lockbox instead of different addresses. 

 

2nd Q:  My concern is the supporting docs for I-485 & I-765 because the whole package will be going to one lockbox center/address, but each form has the same supporting docs, so can I just submit one copy of the following: passport, 2X passport photos, I-94 arrival/departure, birth certificate? Seems weird to be double copying the same docs in the same folder to send to the same address, right? 

 

3rd Q: I-485 form fee is $1440 now. I heard that I-765 (employment) was free to submit if you were paying for I-485 and submitting both together, but that supposedly changed in April. Now I'm confused if I-765 fee is $520 OR $260 to submit together. Also, do you add both fees together on form G-1450 (credit card authorization form) or need to attach 2 separate G-1450s for I-485 & for I-765 for whatever fee I need to submit the later one for?

 

I have everything ready almost, so I'd appreciate your clarification on this so what I can proceed quicker. Thanks you all

1.  They are all sent to the same location for concurrent filing.

2.  Send supporting documents for each form (package).  They are separate entities.  They all need their own documents as stated in the VJ guide.

3.  The fee for an I-765, if sent with an I-485, is $260.

USCIS isn't going to request an I-485.   Send the I-485 (along with the other form packages and a copy of the I-130 receipt).
