Received cr1 visa when I should have received ir1 visa what to do [merged threads]

Hello,

Today I received my green card in the mail. We are very frustrated as followed exactly what visa journey said to do. I married my USC husband june 1st, 2022. I received the cr1 visa January 2024 from the us embassy in peru. I traveled to the US june 11th, 2024 for my first arrival to the US. It was after the two year wedding anniversary. The officer at customs in Florida marked IR1 visa entry. However, I received a two year cr 1 visa in the mail, more than two months after arrival. Should I send in the i-90 immediately and mark incorrect visa issued? Should I just remove conditions in two years? I have read online the i-90 can take a year or more to process.

 This needs to be corrected. You do not need to do ROC but the system will not be able to deal with any N400 application in the future  if you don’t get it corrected or try to apply for ROC 

 

I90. No fee as its their mistake. Include a copy of your marriage certificate, photocopy of the endorsed visa showing the date of entry and a brief cover letter. Keep the GC and then the I791 receipt when you get it. Then just get on with life and be surprised when the corrected GC actually arrives !!!

Yes.  This is a USCIS mistake.  There is no need to remove conditions, as @Lil bear stated.  I have seen some I-90s processed prestty fast.  I hope yours is one of them.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes and if they ask for it , make sure you get a stamp  in your passport from the service centre. Can be hassle convincing them you need an Appt but you need the documentation

Yes. The ADIT stamp is another one like the one placed in  your passport on entry. The one received on entry is valid for 12 months only .  If your card hasn't arrived and you need to travel overseas it is a better document to have than just the  I791

How far after your 2 year anniversary did you arrive into the country?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Around 10 days, I believe.

File the I-90 online.  It's faster and you can't hand over the physical card online anyways.  So hold on to the mistake one until they ask for it back so you still have a physical card in your possession.

It will work. It has to .. because the USCIS system won’t be able to get you through AOS because of your marriage /entry dates .., and it won’t let you naturalize without going through AOS because of the expiry date on the current card.   
Although it is a real pain to get this corrected, it is one of the simplest to document and easiest get through. Apply then move on. You have LPR status documentation for b the next 12 months and can get the ADIT stamp if its not done by then. Let us know how this  journey goes !

Wife sent in i-90 due to mistake of cr1 instead of ir1. She filed i-90 online and sent in scanned copy of physical green card with online application. She has her scheduled biometrics coming up soon. Will she be able to keep her mistake green card after biometrics or will uscis take the physical green card while at biometrics appointment?
